Sponsor Mostly Outside the UK

Hi, One of my friends is a British citizen and she wants to bring her husband here. She is employed by a UK company in the UK and pays taxes on her income in the UK. However, due to the nature of her job, she is outside the UK most of the time (maybe more than 8 months a year). Now, she wonders whet...

Re: Loss of Job After Application

Thank you for your reply however in the links you provided other members assumed that this may lead to refusal but I could not find an actual case being refused based on this. Immigration rules clearly says that the employment should be active at the date of application and nothing said at all abou...

Re: Loss of Job After Application

Thank you again. Your new post actually repeating the previous one and I still could not find any actual that being refused based on this and the post you referred to does not show it as well. Also, rules never says that the employment should be in force even after the application. Paragraph 5.1.1 i...

I forgot to update but the visa in question was granted which shows my understanding of the rules was correct and cash in hand could be used.

Loss of Job After Application

Hi, One of my friend applied for spouse visa and now after two months from the application date (and it has not been decided yet) the sponsor in the UK lost his job and has not found a new one yet. Now, my question is that whether they have to inform the UKVI? According to the rules the financial re...

Certificate of ROA

Hi,

Is it possible that someone with a certificate of ROA travels to the UK and then applies for a British passport from inside the UK? in that case they will cancel their certificate of ROA?

Thanks

When to apply?

Hi, I have a question for an in-country Tier 4 application. I read in the guidance that it should not be made more than 3 months before the course start date. however, in the rules it is clearly stated that the new leave will be granted up to one month before the course start date. Someone told me, ...

Re: Rental Income

I think the concept of mortgage rental income is similar to loan money or third party support which HO prohibits to use in meeting financial requirements. It is what made me confused but it seems that mortgage is not an issue as one of the evidences that HO accepts is Mortgage statement to show the...

Re: Rental Income

Equity is NOT rental income. If their is equity in the property, it basically means it is worth more than the debt. You cannot use this to meet the financial requirements. You can use rental income, provided it is enough and all obligations are met etc. Thank you but i am still confused. so we can ...

Rental Income

Hi, I am a bit confused about the guidance on rental income. it is said that the property should be owned by the sponsor and then said: Equity in a property cannot be used to meet the financial requirement. What does it mean? it means that the sponsor cannot rely on a mortgaged property and they sho...

Re: Cash in Hand Income

It would be appreciated if you give me an example of these refused self-employed as anyone I've seen so far was employed. Also, if the rules are clear the paragraph I posted above is also very clear and explicitly implies that in the case of correct paid tax amount, flexibility can be given. I just ...

Re: Cash in Hand Income

I am asking to know the others opinion. Your reason is for employed people and all of the cases I've found in the forum and all refusals are for employed people and not the self-employed one. The guidance is very clear for both employed (where the cash should be banked) and self-employed (as above)....

Re: Cash in Hand Income

thank you but the guidance says otherwise: ...may only be applied where the decision-maker is satisfied that the cash income relied upon is fully evidenced by the relevant tax return(s) and the accounts information. it is not that easy, financial accounts are prepared by a chartered accountant and s...

Cash in Hand Income

Hi, I've seen couple of thread related to the refusal of the application as the sponsor's cash incomes were not banked. However, what is the situation for a self-employed person such as taxi driver? I found it from the Appendix FM 1.7: Self-employed income can be cash-in-hand if the correct tax is p...

Re: spouse visa self - assessment evidence

I know this is an old thread but given the following paragraph, is it possible for a self-employed to use tax returns and financial accounts to reflect the income? Self-employed income can be cash-in-hand if the correct tax is paid. In line with paragraph 3.1.5 of this guidance, it would generally b...

Re: Reapply or Appeal

I have another question: what does HO mean by unaudited accounts? Is a profit/loss statement and a letter from the accountant that the business is exempted from audit fine or it should include balance sheet?
