Ultimately it is up to you and you can have the argument with UKBA if you want. Residency, which is what the requirement is, does not equate to being in the country 100% of the time. I dont suddenly become a resident of Dubai when I went on holiday last month even if i was physically in that country...

Surely step 1 is to speak to HO for an update and then post what they say.

Given you've paid money for the help of a solicitor then step 2 is to speak to them with the feedback from HO and ask for their advice.

They do sound increasingly like cognitive questioning.

Whilst this is an understandable approach it does however raise the question of what has triggered them to "toughen" the process. With how UKBA have been at airports etc over the last few months it doesnt feel as if it is something good.

TBH, I am not expecting much from them when we go through it.

Experience with any division of the Home Office has never been great but ultimately gotten what we wanted out the end of it so accept it.

We didnt have any recent docs to submit as you only receive the requested statement if are required to pay tax and from the 4 years she's been self employed earnings have been below the personal tax allowance except the very first one.
