Re: Amendment to EEA Regulation from 1/01/2014 Singh diluted

My question is related to FP as well. I am working in Ireland since Nov 2013 and wants to go back to the UK in Jun/July 2014 after completing 7-8 months in Ireland. I just checked the new EEA2 form for RC. The section 5 (SS Case) got new question Please note: if you entered the UK with a valid EEA f...

Re: Non Eu Dependant Sister Extended Family

it is a mission to prove dependency of a old age parent(s) who are by the way direct family members. In your case she is your sister who is a permitted family member and not a direct family member. to make matter worse she is married and have kids. they will refuse it straight away and argue she for...

i hope u r aware of new SS rules implemented by UKBA . you wont be able to move back to UK staright away. her UK refusal wont have any effect on her Irish visa application but Irish and UK immigration do share information. make sure you dont hide any facts.

Re: Amendment to EEA Regulation from 1/01/2014 Singh diluted

I agree with you Rose, that the test for S and G will be pretty tough. But the case of O and B does not indicate a tough test at all. Create or strengthen simply mean, in my opinion, family life established in the host state, such as by marriage, or strengthen by family joining from a third country...

Re: Amendment to EEA Regulation from 1/01/2014 Singh diluted

The court has rather tread carefully in it's passing of the judgment, whilst it doesn't limit SS to the exercise of treaty right by being employed or self employed which is good, it has left "Uncle Denmark" with a big leverage in defining what an established genuine residence would mean in the host...

Re: Amendment to EEA Regulation from 1/01/2014 Singh diluted

I dont think the judgement is that bad at all. Although I would have hoped for it to go further. For people in the UK, it provides an extention of Regulation 9, beyond the economic activity people. It makes clear that rights under Article 6 cannot qualify. But residence in conformity with Article 7...

Guys Judgement in the case (C-456/12) is out, can someone explain what does it mean? Article 21(1) TFEU must be interpreted as meaning that where a Union citizen has created or strengthened a family life with a third‑country national during genuine residence, pursuant to and in conformity with the c...

SS Application and short term UK visit

Hi I am exercising EU treaty rights in Ireland since Nov 2013 and my dependent mother is resident with me. I am planning to come back to UK using SS after 10-12 months. Next month we want to visit UK for 1 week. My mother already got UK visit visa which is valid for few years. Is it ok if she travel...

Re: EU1 Application - Documents returned but no stamp4

Oh dear! Maybe try again and just make sure that they know the garda office hasn't received the letter. When you're on the phone with them ask if the garda office really need to wait for a letter from INIS, or if your letter would be enough. Ask them if they are able to call the garda office. This ...

Qualifying Quantifying period - what the hell is that?[/quote]
abuse of power, HO didn't set minimum qualifying period making it easy for them to refuse application by saying this.
I am hoping we will get positive decision in OS.

I dont think there is a section on eea2 form to declare this. I dont mind declaring it but ECO can argue that i travelled to UK when i was exercising treaty rights in Ireland the same way he objected to this other person who's refusal letter was posted.

Re: Amendment to EEA Regulation from 1/01/2014 Singh diluted

Is it possible for HO to check if an EU national is travelling between UK and other EU state. I travel to UK every month for one weekend. At border control i usually show them my passport. No one scans my passport.
