Congrats Daydream,

i guess with time we will know whether 6.3 is not relevant to Tier 1 General applicants with absences less than 180 days.

i hope people post their experiences here so the rest of us can know how best to tackle this.

Rules take precedence over guidance. Ideally that should be the case, but will the case worker know this? I have a feeling some of the caseworkers don't even know the rules; they simply just follow the guidance notes they have. So when there is a case like this when there is a conflict between rule...

I strongly believe that there is a conflict between the guidnace and the immigration rules. http://www.ukba.homeoffice.gov.uk/policyandlaw/immigrationlaw/immigrationrules/part6a/ Part 6A (255AAA) section a& b clearly states that : (a) "continuous period of 5 years lawfully in the UK" means residence...
