Your HR is confused. They can't just make up their own laws. They have to follow the rules set by UKBA.

I think you need a RCOS and its subjected to an annual limit and RLMT.

Apply for Tier2 from in country. This gets you off some of the restrictions such as limited number of COS, RLMT, Maintenance etc.. It's best you switch to TIER2 from PSW in country.

Get your partner to go back and apply for Tier2 dependant.

This is the best thing to do :)

I'd check the registered sponsors list and filter the companies that I might be able to get a job. Then I would look at their website under careers to see if there is any job vacancies. I would also try and contact them or send my CV.

Have your employer conducted a RLMT for your job?

If you have everything in place there is nothing to worry and we can't really answer whether you will get your visa or not cause we don't know your exact situation.
