Re: ILR rejected due to tax issue

You might be right in saying that HO has no direct access to HMRC database , but HO already has a mandate to speak on your behalf through your application . I believe that HMRC may have dedicated lines for HO and case worker using your NI or UTR number ask few questions about your tax history . If a...

Re: ILR rejected due to tax issue

Thanks Vin123 and fn286 for your replies. He was self employed as a sole trader and went along with all correct documents suggested in guidance . It appears that caseworker while checking out his tax history with HMRC spotted discrepancy and rejected his application . I just want to know that is any...

ILR rejected due to tax issue

I have a friend who went to PEO for the ILR and it has been rejected on the basis of deception. There was a discrepancy in the amount he declared to HMRC and HO while obtaining his Tier-1 extension. He has now instructed a solicitor who advised him to rectify his mistakes and clear his accounts with...

Deception and ILR , How far can UKBA go ?

Re: Child living in UK for more than 7 years

Thanks for taking the time to read the judgement . You are very senior on this forum so may I ask you following:- 1. Does this judgment apply to a new application made under the new rule i.e. after 13 December 2012 . "An amendment to the private life rules will narrow the circumstances in which...

Re: Child living in UK for more than 7 years

You mean 13 December 2012 .

It appears that the appeal was decided on the new rules as HO applied new rules on this case.

Re: Reapply after ILR is refused

It would be little tricky ; you have already shown expenses in your earlier application and taking them completely off will create doubts. However , it is legal to do so but not advisable. It would be better if you can earn some extra money in this extended period ; keep expenses same and go to an a...

Re: Reapply after ILR is refused

OK, So as I understand , you applied and claimed the earning points on the basis of employment + self employment. Your accountant prepared your account; adjusted expenses with your self employment income (Gross - expenses = net income) which resulted in reduction of net income and reduced your point...

Re: Court Convictions

It seems very cautious however I am of the opinion that you must disclosed everything on your ILR application . If they reject on the basis that you did not mention in earlier applications your solicitor /barrister could argue that it was genuine mistake and I have come across few decisions where th...

Re: ILR - Tax return issue

I have said earlier that it is now a days common for HO to ask for your tax history . We know that people had while applying for Tier-1 and extension had shown different income to HO and after approval of their visa declared reduced income to HMRC to avoid tax liability . It is very tricky situation...
