Assuming he will stay with you, it's also important that your provide evidence of you suitable accommodation (deeds or tenancy). From him, he must provide very strong evidence of his soc...

Re: Living in NYC, want to keep options open to return to UK

I don't think it's worth concerning yourself with this, given that you don't intend to move for another five years. The immigration rules change frequently, and five years from now will be different in some way. As long as you have a job or savings in the future, there will be nothing to prevent you...

Re: Spouse/ Fiance Visa application

It's not a case of which is best; it's which is appropriate. If you are already married, the spouse; if you are not already married, the fiancee. Simply as that! You have said you want to marry in the UK, so, obviously, the fiancee visa is appropriate in your circumstances.

Re: Expert Advise Needed!!! just 3months short of 10years

It's safe to assume that long residence applications can take 6 months to be decided so you will not be refused until you have passed the 10 year threshold. You can't make an new application when you are under appeal; you are only permitted to vary the previous application. However, now for the bad ...

Re: ILR eligibility after working abroad

The fact that the company was British is not relevant so those absences will be recorded like any other. But, given that the yearly count is made from the month of entry (or month of application for ILR looking backwards), it's possible to include a gap of more than 180 days in a year if the gap is ...

Re: Citizenship passed on from parents/perm residence/spouse

Your paperwork is not legible. That's why they challenge you rather than for only having ILR. Most US citizens living in the UK do not naturalize so it's not an issue to stay with ILR rather than apply for naturalization. In any case, you are already British by descent and have been living under mis...

Due to increased pressure from border control each time I come home Such as? What are you referring to? If you are domiciled in the UK there should be no problem; if you are domiciled in the USA but make a cursory short visit to the UK simply to retain your ILR, then, yes, I can see you being quest...

Re: Registration of Child born abroad - Requriement for ILR

Child born abroad So, it was a correct decision. Child needs ILR before naturalization. Direct registration is only permitted if the child is born in the UK to parents who later acquire ILR. Could have applied for ILR with the mother but that ship has sailed. Need to apply now using SET(F) https://...

You are eligible to apply for ILR anytime on or after 17th April, so you are easily within the limits of your current leave.

Re: EEA Family permit for my mother... pls help me.

From the little information your have provided, I am trying to guess why you think this will work - because it won't. If you are a British nation living in the UK, I can't see how your family members can apply under EU rules (Singh). Perhaps in the past, with your wife, you had been exercising econo...

So why can't she simply leave sooner rather than later? Otherwise, you can ask your employer to extend your leave and extend hers on that basis. Not to...

Re: Tier 2 ICT Long Term Visa expiring but Dependent is preg

Do she have a particular or abnormal condition? Otherwise, to suggest that a 6 month gestation can't fly is absurd. The only bar on flying in normal gestations is placed by the airline itself, and this varies between 28 and 36 weeks. 36 is the cap, but flying after 28 up to 36 is okay with a doctor'...

Re: Tickets to UK before or after Visa confirmation

No, there are no questions relating to tickets or proof of travel on the application form. The face to face meeting you seem to be referring to is merely to hand over the application at the VAC. The person is not an advisor and should not be asking for material that is not required. If your GF is, i...

You have to list your absences for each 12 month period over the five years.

Look at page 21 and 27 of the application form.

Employment is not a requirement. Business ownership or directorship is not related to any type of immigration status. You can be a director or owner of any type of business but, under your present visa, you can be an employee of that business.

Your next extension is based on scoring 75 points. Will you be in a position to claim 75 points (as defined on page 2 in Appendix A of the immigration rules)?
