Your original question was about whether to appeal or go for an AR and I think we have solved that for you. An appeal can take up to six months but there may be an opportunity to reduce this to 8 weeks if the ECM review part of the appeal agrees that there has been an obvious error in the original d...

Re: ILR documents for Self Employed

I opened my own company and have been working for a US company since then. Can you clarify this as it's rather confusing? Is your company providing a service to the US entity and is the revenue from this being declared to HMRC as part of your company accounts? Or are you saying that you are employe...

It's after five years of residence but also having met the conditions for permanent residence. Those conditions include, but are not limited to, exercising treaty rights throughout the five year residence period and no breaks of more than six months. No effect on the extension but you'll have to wait for a court fine to be spent before you can apply for ILR. Hindsight is a wonderful thing but it would have been better to accept the fixed penalty as that would not be considered.

The caseworker was correct that you don't have to switch while your current leave is valid but you will have to switch at some point before your leave expires if you want to be eligible for ILR. In the current immigration rules, 319E appears to offer no scope for PBS dependants to apply for ILR unle...

AR is only applicable to PBS migrant applications. PBS dependent applications are not covered by those rules. You will have appeal. Administrative review is the process used to look at whether claimed points have been correctly assessed and therefore only applies to the main migrant. Applications fo...

You can use any bank account or combination of accounts that show the required sum held for the required period but it seems obvious that an account where the overdraft facility has been used will not have held the money for the required 3 month period. Where is the other parent? If not in the UK wi...
