Re: US Citizen and UK resident - DUAL Citizenship Questions

There are no benefits to speak of other than his own children can be born outside the UK and acquire BC. Some (very few) high security professional situations require candidates to be EEA citizens but, otherwise, a permanent resident of the UK has the same social rights as British citizens. Most US ...

Re: urgent - visitor visa refused

Showing that you, as the sponsor, have money while showing nothing for the applicant is a common mistake. You could a millionaire but in spite of this, without having strong social and economic ties to the homeland, anyone you sponsor might be refused. Additionally, applying for a long-term visit vi...

Re: ILE granted and withdraw

Yes, right, but in this case the person involved is now outside the UK:

Therefore if an applicant has not left the common travel area since being erroneously granted indefinite leave, any subsequent limited leave to remain will be void.

Re: ILE granted and withdraw

I am intrigued but this discussion. Sure, I too can't find a written directive permitting this but I can't find one allowing it also. But what about this: If someone applies for a visit visa to the UK, and the ECA (locally-hired assistant) who prints the vignette (that is what they do, amongst other...

Re: Double Descent Citizenship?

British nationality passes only a single generation for children born outside the UK. From what you have stated, it's likely that your dad is British (by descent, as the first generation child of a British citizen born outside the UK and assuming your grandfather was married to your grandmother). Bu...

Re: solicitor cost to lodge an appeal

For the appeal, you need to indicate the very pressing and unavoidable circumstances which compelled her to remain outside the UK. The fact that she 'lived' there for only a very short period, has not established any type of life or links in the UK, (other than your remittances to her in her country...

After you, please! You really have not provided sufficient information about the reason for the refusal for anyone to be able to make an informed comment on the type of appeal.

Re: £18,6000 financial requirement advice

In order to get the advice that you seek, you need to define your so-called jobs. Are they employment or self-employment? Getting paid via Paypal seems to suggest that the task is not employment (where your employer deducts tax and NIC from your salary).

This forum is not a Quiz Show where contestants are asked to guess and win prizes! How can you expect help if you don't give relevant information about your circumstances. You say you are a T4 migrant at a private college (only that, nothing else mentioned) and as such you can't bring your wife into...

No, absolutely no chance at all, because it seems that your college is not a recognised body and you haven't given any information for us to doubt that fact.

Re: Online application outside UK - Tier 1 General dependant

Yes, the main applicant if the migrant worker rather than the dependant and there are specific questions that refer to him/her. Otherwise, all the questions on the form are directed at the dependant. So, unless it refers to main applicant in the question, the dependent partner must answer giving his...

Re: medical visa?? how to obtain... what visa category???

I am sure it is (serious) which is why I said you really have no chance with this. People who don't qualify for general visit visas (your sister was refused due to lack of social and economic ties) are also not going to qualify for a medical visit visa. There would need to be diplomatic intervention...

Re: medical visa?? how to obtain... what visa category???

Truthfully, you should not waste your time unless there are no qualified professionals in that area of medicine in her country. If she does not qualify for a general visit visa (lack of social and economic ties) she will not qualify for a medical visit visa either, as the general visit conditions ha...

This is not a route that will allow you to circumvent the immigration rules with regard to elderly and dependant relatives who don't qualify as your nuclear family ...

You have not said if you actually want her to settle in the UK rather than merely visit. Is the intention for her to live in the UK as your wife or will you be leaving the UK to live with her in her country? If it's the former, she needs to apply for a spouse settlement visa. You can say the visit v...

Re: Student Visa Valid - Travel allowed?

If you are not returning to continue a course of study you should not be using a student visa to enter. That's what the rules say. However, given that you have a valid visa, it seems absurd to ignore that and apply for a visit visa to serve the same purpose. Your entry depends on how you react to an...

Yes, you can stay longer but the next time you visit the UK you may be challenged and refused entry. So, no problem if returning is not a priority. What caused this event? If your ticket is de ida e volta within one month, did you mention to the official an intention to stay longer than that?

It's fine to leave the UK but will need a visa to return. An Indian passport holder will not be allowed to board the aircraft if there is no valid visa to enter the UK. The fact that the child was born in the UK will not be considered by the airline check-in staff as that is not within their capacit...

I'm only citing the requirements in place when I applied for my kid's British passport. It should not make any difference. T1 categories are not contingent on you currently working for a specific sponsor for which you have to provide employment details, so as long as you, yourself, have valid leave in a T1 category and can show the relevant maintenance requirements, they should be able...

You would only be able to vary your appeal to ILR within 28 days of the end of the 10 year residence period, but the train would have run out of track some 4 months beforehand.
