Just had a call from the embassy. I told my wife to kick off at the embassy, which she did. They had to call the police to remove her. I then phoned the embassy, visa section was closed. can only call between 1000 and 1100. I explained a situation but my call credit ran out as he was talking. Anyway...

I will post it as soon as I get a clear view of it. It is so stupid! I quoted the directive on letters and emails to them and even provided snap shots of their own documentation guidelines which are posted on their website!

Are applications assessed by locals or diplomats in an embassy abroad?

We got the visit visa becuase at the time my wife only had a temporary 6 month Stamp 4 resident card.

We have not applied for the RC in UK becuase we do not live in the UK and currently have no plans to do so.

When we do decide to go back to the UK we will avail the Surinder Singh route.

That's correct. I am a British citizen and my wife is non-eu. Currently in Ireland working.

1 thing. My with does have a 5 years valid Irish Residents card. Would she have to hand this in when and if we go to Baku. We might go but we have not decided.

As this will have EU FAM on it, we can use it to enter the UK in the future, visa free and then apply for the correct EEA family permit?

Yeah - but in Ireland, while they are processing your residence card (they take the full 6 months) they issue you with a temporary residence card stating Stamp 4, not EU FAM so this is not recognised as the correct EU FAM permit. Hence the reason why we got the visa for UK. Turns out an added bonus ...

My wife does have a tyce C visit visa for 6 months in her passport. We are going tomorrow for a visit. The visa states accompany EU spouse "my name"

This is what you're saying as entered under European Law, no?

I thought about that but they will most probably check for a UK Entry visa when boarding the plan in Azerbaijan. Lucapooka - Thanks for the advice. Really though, I don't think I would want to risk taking the baby out of the EU without an EU passport.
