Re: Form AN Question

Just call up HMRC mate and ask if you owe then anything, if yes then how can you set up the payment. Its all up to the immigrant to have everything sorted unfortunately, neither HMRC nor HO care who's fault it maybe but if the taxes aren't in line then HO will hand down a refusal even if it was HMRC...

Re: Form AN Question

Only minor FPNs like speeding, parking etc can be omitted, all other traffic offences have to be declared Have you declared it in any previous application? if not then just skip it since its already spent now Quite contradictory to what you said above (listing the conviction regardless of what happ...

Re: Form AN Question

FPN means you broke the law and it means a criminal offence although traffic offences can be spent after a few years but the form is clearly asking to declare all traffic offences and not just those which happened in the recent past or are still unspent, in which case it will be a refusal for 3 years

Re: Form AN Question

Dude, have you read the form before posting or selecting your referees?

read 5.1, it clearly states the 2 referees should not be related to each other.

Also read 3.7, you have to declare all road traffic offences regardless of when they happened.

Re: Non paid TAX and naturalisation

You have to sort out all the arrears with HMRC first, HMRC may not be bothered with the amount but its up to you to clear it or it will be a straight refusal from HO if they find out, especially since its been outstanding for so long

Re: ILR Refused - Out of Country Right of Appeal

Don't wish to discourage you in any way but I have heard of similar cases from immigration solicitors. A doctor with an established family life in UK with 2 kids had a very similar experience, submitted the application which was returned due to payment issues, he got in touch with a lawyer who prepa...

Re: 5 Year rule

I am not entirely convinced that the Home Office accesses APIS for the purpose of verifying presence or absence from the UK. It would then not need to ask for your passports as it would have all the data already and would only be trying to make the application more onerous. Besides, Europeans in ge...

Re: Absence overlap - over 2 consecutive periods

You cannot (and don't have to) include a single holiday in any 1 specific year if it spans 2 consecutive 1 year periods. If the absences are less than 180 in a year then its fine.

Re: Absence overlap - over 2 consecutive periods

What you mean by 1 absence overlaps between 2 periods?

Post your absence calculation for the last 5 years.

As long as absences are less than 180 in a year then it should be ok

Re: Changing locations after ILR

Once you get your ILR, breakdown of a relationship means nothing even if you achieved your ILR on the basis of a subsisting relationship at the time of application

Threats of revoking ILR by the main applicant are just hogwash and you do not have to inform anyone
