I am just guessing here, but I think your PSW visa for only for that. If you intended to get married you should have applied for a fiance visa from the county you originate from after completing the 2 years PSW visa. Then you would have the visa to come back to the UK and get married. I am not sure ...

I would say Pakistan because the British Embassy in Pakistan would understand and identify original certificates much more easily then in a foreign country.

I did the ESOL speaking and listening only A1. It is for basic English understanding and speaking. I doubt if you need reading as well. So I guess she is fine.

I think you should ask for a letter from the UKBA explaining their reasons and make an appeal on the old laws that were in place in 2006. Use a lawyer to argue the legal points for you.

You should read News on the UKBA website ( Automatic settlement for skilled workers to end ) and see if it applies to you. In April 2012 the threshold is believed to be increasing to 35000 K. Therefor I would apply before April.

I took the ESOL test Level A1 in the UK. It is very simple speaking and listening only. If you can speak basic English then you will pass. Takes 4 to 6 weeks to get the certificate.

Are you saying by the fact that she lives in the UK as an EEA national without a residency stamp, that the UKBA will accept and grant a me a fiance visa.

She is thinking of getting a British passport but that will take 6 weeks and I want to apply this week.

English Test

The English Test for a fiance visa is ESOL speaking and listening only. Note it is very easy if you speak English already. They ask you questions and then you answer. On the listening section they ask another applicant to discuss a topic with you. Just listen to the topic and discuss all the points....
