It is to do with gaps between applications I.e., if the previous permission to stay expires and the applicant makes a fresh application even after 28 days it will still be considered valid. I would say yes as now a days brp cards are issued and hence the passports are not needed. You could apply with their old passports n the new passport numbers. But it might be worth checking with the PEO b4 hand.

You can apply 28 days before 20/05/2013. This is the 28 day rule.

Difference between 20/05/2008 and 23/05/2008 doesn't matter as you entered within 90 days of your entry clearance.
