Re: living abroad

No, you are not eligible for ILR. You have to be resident in the UK for 5 years before you can apply for ILR. To come to the UK, you will need a spouse visa. See link below : https://www.gov.uk/join-family-in-uk/overview Your British spouse will need to be earning £18,600 per annum or have substanti...

They will probably write to you and ask you to pay the difference of £99 before being able to proceed with your application. Another user recently had this happen and he had 14 days to make the additional payment.

Re: Registering an infant on discretion

What is the status of the mother? The case for your daughter's registration would be stronger if both parents are settled. I am in process to apply for their dependent visa to join me in UK. Once my daughter is here I am planning to Register her as BC on discretion. @faislondon, unlikely your daugh...

Re: Citizenship: under 18 and Some Questions.

Firstly, how do I go about with the biometric enrollment? Where should I go to get it done, what questions should I ask to ask for it and how much does it cost? What do I do with it after that? Once you have submitted your application, Home Office will write to you to do your biometric enrollment. ...

Re: Indefinite Leave to Remain costs

Correct, ILR is exempt from the NHS surcharge.

£4,500 would be for a postal application, which can take a few months. If you want an in person appointment for all three of you to get a decision on the day, it is an additional £400 each premium service fee on top of the £4,500.

Re: Dependent Tier 1 extension or ILR -- Pls advise

She needs 5 years residence at Tier 1 dependent to qualify for ILR. A PBS Dep extension application should be given for 2 years so that she meets the requirement for ILR. I suspect that if she switches to FLR(M), she might have to wait a further 5 years in this category (2 x 2.5 years) because her c...

Re: child tax credit

Tax credits must be claimed jointly with your partner. So the answer is no, you cannot claim as a single claimant.

Joint claim for tax credits will NOT have an effect on your partners visa or future application for ILR.

Child benefit MUST be in your name only.

Re: ILR applications for PBS deps - Spouse Set(LR)

She will need to switch to FLR(M) and yes, her ILR clock will reset and she will have to wait a further 5 years on FLR(M) - 2 x 2.5 year visas - before she qualifies for ILR. Her time spent as PBS dependent will not count towards this new 5 year period. She will also have to pay the new NHS surcharg...

Re: Indefinite Leave to Remain costs

If you are on an Ancestry visa, you can extend it as many times as you wish, you are not obligated to apply for ILR. However, bear in mind that if you do this rather than apply for ILR, you have an additional cost of £1000 per person (main applicant and each dependent) for the new NHS surcharge. So ...

£1500 per person applying for ILR, whether main applicant or dependents. There is an additional charge of £400 per person applying if you select to go for premium service appointment. https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/419449/fees_table_for_website_2015_03_30.pdf

The process of checks etc is only done once allocated to a caseworker AFTER the fee is taken.

As we don't work for HO, it is vague on what happens but there are many checks that they do across different areas.

Employment is not a requirement for citizenship, neither is studying. You only need to send these documents if you DO NOT have the passports covering the residence period.

It should be ok.

But, if you are concerned, will it be a very big issue to just wait for 23 days before applying so that his absence is within the limit, provided of course that he was then physically present in the UK 3 years before exactly.

Re: Visa for Child of ILR Father, Tier1 (G) dependant Mother

It is a PBS Dependent application. Child is the applicant. Leave will be granted in line with mothers leave and have the same expiry date. Surcharge is payable for child, not you. Amount will depend on when the mothers leave expires but the amount will probably not be more than £600 for the child (c...

You will have to wait until you collect your documents to find out what the outcome of your application is.
