The rules allow it but ONLY if you apply for ILR based on Tier 2 and not long residence.

You likely could have applied for ILR in 2014 already as your visa was issued under the old rules in place before 9 July 2012.

Why is she not applying for ILR if she got her Dep visa when you got your main visa?

Tier 2 General Partner is what is selected I believe. We can't see the options you are seeing.

What date did he enter the UK?

He will have to apply for an extension as he is short of 5 years residence at that point.

If you apply for ILR based on Tier 2 and 5 years residence, he can extend his PBS dependent visa.

Unusual for his dates to be different to yours, especially the visa end date. Did you apply for a visa extension or change of employer without him?

There is only ONE visa category that is exempt and that is Tier 2 ICT applicants and dependents. ALL other visa applicants have to pay the surcharge.
