Re: ILR refused. Admin Review OR FLR (FP)?

@protagonist8 Sorry for the delayed response. Thank you for the information. In worst case scenario, if HO refuse AR and I apply for FLR (FP) and also file JR, will my previous leave continues? Will I be allowed to continue my employment and business? I request Moderators, seniors to comment on thi...

Re: Skipping ILR for foreign born child

No, he has not entitlement to Register as British. Children born abroad are expected to hold ILR (free from immigration time restrictions/settled) in order to qualify for citizenship and children born abroad can only apply for citizenship if one or both parents are applying at the same time. If you ...

Hi Raghu, I am going through a similar situation as yours. Was wondering what was the outcome of your visa application with out a tb test report???? I just came back last week to my country(tb test needed) to apply for a tier 2 visa after living in the UK for almost a year now on two visit visas. S...

If JR is in your favour, then 3C will become engaged again. If it is not in your favour, you are an overstayer from date of visa expiry.

Re: 5 Year Tier 1 General short Fall of 31 Days PLEASE HELP

Date of application is never used as the starting point of the qualifying period for ILR. You applied a bit too early for your extension in 2013 and should have applied closer to your visa expiry date at that time. The only thing you could probably do is apply by post as close as possible to your vi...

Re: my Fear

Actually, I think my arithmetic is wrong. I forgot the cost of the Nationality Checking Service (NCS) is around £40, and for UKF applications you just pay the cost of the ceremony. I am now thoroughly confused myself! Is form UKF only for adults? The guidance claims the form is only for those born ...

Dependents are not required to meet the salary requirement. It is only the main applicant that has to. Your wife can be a stay at home wife for the full 5 years and still apply for ILR as a PBS dependent.

Have you done any research on this visa category?

https://www.gov.uk/tier-2-general/family-members

A. See link above
B. Does the letter state maintenance for main applicant and dependents? If not then no.
C. Whose application would you do first?
D. No, not that I am aware of.

Re: Divorce for British Citizen, married in India.

Ah ok, sorry to hear that CR001. Yes, I agree a divorce is possible in the UK. I was somehow of the impression that OP was needing to know if it would still be recognized and accepted in India. They could still do the UK divorce and then register in India I suppose. But given that they are no longe...

You write the details of the address where you both lived, as the question asks. It is not a trick question.

Likely she will get a 2 or 3 year visa extension as PBS Dependent.

There is no income requirement for PBS Dependent. You need to show maintenance balance.

Re: Re-entering after Tier 5 expiry

You should leave before or on the date of your visa expiring. Once your visa expires, you won't be allowed to work, rent, use the NHS etc. Any reason why you cannot leave before or on 21st July? Likely you will face problems trying to re-enter as a 'visitor' immediately after your current visa expir...

Re: Criteria for ILR for Tier 1 General Category Visa

You are allowed 180 days absence in a 12 month cycle. So depending on when you plan to apply for ILR (month) you count 12 months backwards (say June 15 to May 16). So 180 days per 12 months = 180 X 5. When did you wife first get her dependent visa and come to the UK? ILR for Tier 1 G is only closing...

I am specifically commenting on divorcing in the UK as habitually resident (given OP and his wife are both British). I am currently going through this process and was married abroad.

DO NOT do an IVA. An IVA is recorded on the Insolvency Register and is legally binding. HO always checks the Insolvency Register. IVA is one down from full bankruptcy. DO NOT do a Debt Relief Order either, second down from full bankruptcy. Contact Payplan or National Debt Line or Citizens Advice Bur...

Re: Naturalisation query.!!!

What I understand is, both my child & spouse has to apply for ILR and ger the ILR done. Once I get my citizenship in Jan'2017, they can apply for citizenship without any minimum period spent on their ILR. (I can do their ILR & citizenship with even 1 month gap).
Correct yes.
