However, I would express caution in applying on the grounds of Human Rights based upon medical grounds unless your father has a severe terminal illness.

I would say it depends on the nature of the offence. But I would imagine that the relevant authorities would not allow the Home Office to remove someone if there is a possibility of them being charged/sentenced etc.

I cannot say for certain but the chances are that you have been banned for obtaining leave to remain by deception. Which I believe carries a 10 year ban. I suggest reading the Immigration Rules very carefully and seeing if you meet the criteria.
