no such rule. you are eligible to apply 28 days before your 5th anniversary. you can apply anytime after that, doesnt matter when your visa is expiring
all you have to do is move the application date 60 days forward (assuming no holidays in next year, which u have, so it will be more than 60 days,. do some maths) .. in doing so, the last year absences will reduce to less than 180

this is not uncommon. At times, the p45 notification to hmrc is not recorded, and the employer still continues. As long as it shows that there is no income from other employer, u should be fine.
if the original was colour copy and u photocopied it coloured, then both copies would have been coloured. No reason to feel that just cos its black, its not original.
