Sorry but now you are just jumping to conclusions... This whole discussion here is based only on the 'testimony' of an involved party which unfortunately means that there may be a lack of objectiveness. We have not enough facts to fairly judge this case. The interview just outlines a visa officer's ...

If this is about a permanent residence application you can just explain your situation in a cover letter. E.g. mention (plus documentary evidence) that you had comprehensive sickness insurance and sufficient funds for the gaps (and needed no recourse to public funds). You could than also write that ...

If you do not receive benefits (or maybe just in moderate amounts) self-sufficiency should be a safe fall-back options. But the question is what 'voluntary' unemployment really means. I do not think that you have to maintain a work relationship when it becomes apparent that it is unreasonable to sta...

You are "just" a job seeker (registered and actively looking for a job). You can maintain this status for six months or maybe longer if you can prove (should the need arise) that you have a genuine chance of landing a job. I do not see why to declare yourself as self-sufficient at the moment (which ...

I'm slightly confused. I thought the lawyer is Australian? In any case, I refer again to the list of documents that were mentioned in the article. If that was all I can see why it was not sufficient.

Can we drop this prostitution argument as there is no evidence that it played a role in this case.

Thanks for changing that last paragraph... The problem is that the embassy is legally required to check the probability that the applicant will return home. Obviously that gives a lot of leeway to embassy staff and can be interpreted in many ways, quite often to the disadvantage of the applicant. Fr...

The Thai girl's problem is a standard one: young, apparently unbound, unfinished education which all easily translate into the refusal given. Invoking 'prostitution' because the Consul had mentioned this earlier in an interviews is unnecessary and just sensationalist.

'Duration of Stay' means exactly what it says. You may have your next visa refused or maybe even a re-entry ban is possible. I would not rely on oral advice.

And there lies the problem. You opine that CH can unlaterally make this change without actually arguing why. I am of the opinion that they can't because the Schengen agreement gave CH very clear rules how to operate their immigration. They cannot easily break out of this as mentioned earlier. Why s...

How so without being in conflict with the Schengen rules or the bilaterals? Neither provides for visa-free travel as you say. How do you propose to break out of this corset? Does the Schengen agreement allow extensions beyond the original agreement (it would obviously not be a problem for the other...

It´s a bit difficult to understand, but once you do you see how stoopid this is, and it´s EXCLUSIVELY the Swiss authority´s fault. In order to bridge the gap, they could -as before Schengen- unilaterally accept "family members of EU-citizens who are usually visa-required in Schengen, but resident i...

In the German version the wording uses a verb that means "to make easy" which of course I specifically refer to . Well, facilitate is probably best translated as 'erleichtern' and vice versa although ' every facility' is more than just 'making it easy'. What I still keep wondering is why the 'join'...

I agree it's rather silly of them. Of the Swiss? They do not have a legal choice. They would need to amend their bilateral agreement with the EU. Problem of that is that the free movement agreement is part of a bundle of agreements. If one falls all fall (Guillotine clause). Also, a new popular vot...

There is no point of enforcing it at uni because there is no requirement for EEA nationals to have CSI. The burden of proof is on the applicant. The UKBA is not required to check on their own if you qualify or not.

Non-EEA family members are not legally obliged to hold a Residence Card. But you should still have proof of relationship when crossing borders.

Your RP may be a proper ID without the passport in the country of issue but not in the country to be visited. When EU citizens are required to carry passport/ID when crossing internal borders (that's the minimum requirement in the Directive) their family members are too. Anyway, since you plan to fl...

Switzerland is not a member of the EU and so the directive does not apply there. Freedom of movement does, however, and it is possible to get a free visa under similar arrangements. One can travel to Swiss on a Schengen visa , IMO. A visa national is required to have a Schengen visa for Switzerland...

I agree that those 'expert levels' should go away. Awarding credentials by way of a simple account based counter is obviously silly and doesn't tell us anything about the person behind the account. I suggest not to speculate on processing times. Whatever people here say, those are individual cases and you can't be sure that those are in any way representative for the overall process (as far as I am aware of there are ten thousands of applications each year). I suppose you know that you can ask...

No. Work restrictions must be lifted no later than 7 years after accession. That's about the host member state and not about Croatia.
