I just admit I was not aware of the 2012 McCarthy Ruling and I'm a little peeved. To travel back to the UK we have always applied for an EEA Family Permit. But this is getting to be a right pain. The waiting times even for the "express" €120 service are sporadic. Sometimes 10 days, sometimes 8 week...

Temporary absences of 6 months in a year, or 12 months in exceptional circumstances, won't affect the continuity of your residence (Article 16 of the Directive). COA received back - 23/01/2013 ( dated 18/01/2013)

Right to work confirmed for my Wife, and application dated 27/12 when sent, not 28/12 when received.

Neep, i'm a dual national exercising my Treaty Rights to have my Wife with me here in the UK. My advice to you, would be too go down the EEA Route, just as you're doing. Far less hassle, far less expense.

My Wife is Thai, and yes she was required to get the TB Cert before the FP was issued. I was going to say this, but we had just came off a 13 hour flight. I just wanted through, less hassle the better!
