Re: EU settlement scheme - no biometrics, got COA

There's also been at least one tribunal or court ruling that time before counts towards the qualification for PR. Can you share details? Yes! The judgement is recorded at SSHD v. Idrissa Kamagate and it was discussed at topic https://www.immigrationboards.com/eea-route-applications/eea4-pr-applicat...

Re: UK Citizenship advice for my EU husband with EU Settled status

Irrelevant in his case. He has got settled status under the new EU settlement scheme. The Scheme allows students and unemployed but self sufficient people to get the equivalent of PR without sickness insurance. Does settled status retrospectively change whether one was 'in breach of the immigration...

Re: EU settlement scheme - no biometrics, got COA

5 years after the establishment of my relationship with my EU sponsor (in my case, the date my EEA card was issued), regardless of any cohabitation time before that, and regardless how long I have been in the UK. Did they use the phrase "establishment of relationship"? That can be taken several way...

2. I have spent quite a lot of time outside the UK since April 2018 - will this affect my application for settled status?
If you have retained PR, this will not be a problem in law. You may have to find evidence that you have not lost PR by a 2-year absence.

Re: BRP CARDS OR SETTLED STATUS.

Thanks very much for your reply. So I will apply for the PR then settled status after that. They do not qualify for registration because they were born after I became British Citizen and that, they are deriving their status through my wife (their step mother) who is EEA citizen. If you're not inter...

Re: BRP CARDS OR SETTLED STATUS.

I am wondering should I apply for PR for them or Settle status? I know with PR, they will be issued with BRP cards which I think is better; however, settle status only comes with email. In case I apply for BRP cards for them, do they need to still apply for settled status next year when they will b...

Re: EEA Residence and PR - Please suggestions

Well, you could bridge the gap by applying to the EU settlement scheme now. You will need to apply again once your residence card expires so as to upgrade from pre-settled status to settled status. It will help if your partner already has settled status.

Re: Applying for Settled Status - A few questions

- We have a child who has a British passport When was the child born, and how did you prove that you were 'settled'? Will the evidence still be available in 20 years time, in case HMPO no longer trusts their previous checks? 2) My wife entered the UK in May 2015 but the 5 year Residence Card was on...

Does a comprehensive sickness insurance count as evidence?
CSI is not required.
Is it not needed, though, to prove that she was a qualified person before settled status was granted? (Being a permanent resident would also be good enough.)

Re: Naturalisation EU child

My children and my wife acquired settled status last year March. They are all EU citizens. My son was born in 2014 and my daughter was born in 2016. Do you think I can apply for British passport for my children straightaway without naturalisation? As Secret.Simon explains, they don't automatically ...

Re: tricky -Re Naturalisation as British citizen - not employed during qualifying period

Yes, my spouse was working and did support me. But does British citizen working in the UK (his home country) constitute 'exercising treaty rights'? As you seem to have lived together only in the UK, no, I'm afraid you can't use Surinder Singh, (There's nothing in Surinder Singh that restricts it to...

Re: tricky -Re Naturalisation as British citizen - not employed during qualifying period

So since I took a settled status route (which does not require CSI) and will be relying on it when applying for naturalisation is it the case that HO will be disregarding it too ? But you only joined that route when you were granted settled status. Until then, your status for nationality law depend...

Re: tricky -Re Naturalisation as British citizen - not employed during qualifying period

It's not unlawful residence if you didn't have CSI - this would/might only be an issue if you were to apply for a document certifying PR under EU regulations. You are relying on UK immigration rules (Settled Status) which has no requirement for CSI. The requirement is that during the preceding 3 ye...

Re: tricky -Re Naturalisation as British citizen - not employed during qualifying period

Maybe I'm overthinking it and am mistaken but from what I've read that you would still need to have had a CSI (comprehensive sickness insurance) for the periods when you weren't employed/ self employed during qualifying period in order to be considered lawfully residing in the UK/in breach of immig...

Re: NATURALISED BRITISH CITIZEN & DEPORTATION FROM UK

I'm not sure what you mean by 'entitled to British citizenship'. If you mean entitled to registration as a British citizen, then until last year, committing a serious offence would nullify that entitlement. so UK Gov would not give its citizenship to someone who is entitled to register as a British...

I know it sounds redundant, but, do you think we'd have better luck traveling by train? Yes. Airlines and ferries are required to keep those without the 'necessary documents' from reaching other countries' immigration. You need to be able to reach Schengen immigration officers, and that can most re...
