Re: Visa options for UK national bringing back Taiwanese wife and child (UK national)

A mistake: rental income is between £1000-1600 a month. Several things: It's quite important how much that (non-employment) income is. If it is above £18600 in the previous 12 months, you can apply using Category C. As your child is British, you need to have £18600, not the higher amount. A LOAN wi...

I'm just got my British Citizen last year, I have a partner and a son from Philippines. How can I bring them here in UK eventhough were not married? Thanks Have you been living with them for the duration of the last two years in a relationship 'akin to marriage' ie, shared financial responsibilities?

Does this mean that he has to get a legal document and then we need to remarry. His marriage and divorce was done islamically. Neither one at the courts. When we married it was a court marriage. If his previous marriage was the reason for a previous refusal (which has to be declared), then I would ...

Thanks. It's a shame that we need to be married (now or soon) in order to be together.
Thanks for your reply.
This would be the case if you looked to move to the US too on the basis of your relationship.

Thems the rules.

Re: PRIVATE LIFE VISA HELP! PREGNANT

So it appears that he does not qualify as a partner (not married and you haven't been living in a relationship akin to marriage for two years). It also appears he doesn't qualify as a parent until the birth of the child. The rules are the rules. You have to comply with them in order to be approved a...

Can this application be made anytime within the 52weeks period that the sponsor is on maternity leave?
As long as your partner is here legally (not as a visitor. He currently ticks that box) or applying for entry clearance from a country where he holds legal residence (not just visiting).

Re: Slightly unusual situation

To anser about Vegas, it's the easiest state to get married in, no intrusive checks or anything like that. Just book your appointment to get the license, turn up and get married. I can't do this in the UK as I would need to show previous relationships have ended. The Vegas marriage is recognised as...

Re: Russian mother with Bulgarian Permanent resident card (but not Bulgarian citizen)

Would your father be coming as well? She would qualify under EU rules.

Is she dependent on you?

If she comes without him, she will likely need to qualify under UK rules in her own right.

Re: Advice required - Application as the father of a British child

The OP has clearly stated child was born after Polish mother got ILR/PR. Right, but is that clear on a birth certificate that the mother holds PR? I do not for one second doubt the child is British, but wonder if it is clear from the birth certificate alone (showing the child was born in the UK to ...

Re: Advice required - Application as the father of a British child

Hi, Anyone want to make a comment on this please? How are you proving the child is British? If his mother is listed as Polish, and you aren't listed as British, how is the IO meant to ascertain that the child is British. The most straightforward proof of a child's citizenship is a passport, as wher...

I know you didn't quite ask this, but she cannot apply from within the UK for a PBS dependent visa. She needs to apply for entry clearance as she cannot change from a visitor visa (even a marriage visitor visa) to any other category. A marriage visitor visa is multi-entry, but if they ask her plan a...

Yes - he is currently back in Pakistan and the application is for entry clearance as a spouse
In and of itself, the previous overstay is not grounds for refusal. Illegal working, use of deception, etc... are different matters which may or may not be relevant to his case.

I may have misunderstood, but your bank statements need to exactly match the stated payment from your payslips. So you can apply when these conditions are met for 6 months. You need 6 months worth of pay slips and bank statements.

Just going to throw this out there - by 'insurmountable obstacles' they essentially mean you would need an asylum claim to be legitimate in the UK, ie your life is at risk because you would be targeted specifically in the other country. I am sympathetic of not wanting to move out of the UK, but what...

I'm worried we won't qualify for this. You don't. You are not permitted to 'live' in the UK on a visitor visa. I suspect you have been incredibly lucky to be allowed back in after each visit to the US as you been, in effect, living (contrary to visitor visa rules) in the UK. Have you been working? ...

Agreed. In addition, it is outrageous that different countries have different rules/ laws, no?
