Yes - he is currently back in Pakistan and the application is for entry clearance as a spouse
In and of itself, the previous overstay is not grounds for refusal. Illegal working, use of deception, etc... are different matters which may or may not be relevant to his case.

For clarity, is this an application for entry clearance? Is he currently abroad?

Re: Spousal visa with dependent child staying in the US. Letter from parent.

Thanks everyone for your answers. You've been really helpful. I have another question if anyone is able to answer: My husband has been married twice before. Both times in the UK. For the Spousal visa application for me to join him in the UK, does he need to provide his divorce certificate (absolute...

Re: UK visit visa for a spouse before applying for a spouse visa

A visit to the UK after having submitted an application will invalidate the application. In order to visit before the application is submitted they would have to show strong evidence for leaving the UK at the end of the visit. Can more light be shed on ''A visit to the UK after having submitted an ...

Thank you. Now does this only apply to people applying from Asia? The xxxxxx website that you have provided a link to states this may not be the case for other countries. US applications haven't been sent to Sheffield since last September (September 2018). Info for the application process: https://...

Re: Salary increase in the 6th month for Spouse Visa

I may have misunderstood, but your bank statements need to exactly match the stated payment from your payslips. So you can apply when these conditions are met for 6 months. You need 6 months worth of pay slips and bank statements.

Re: Help/advice required, both panicking and scared

Just going to throw this out there - by 'insurmountable obstacles' they essentially mean you would need an asylum claim to be legitimate in the UK, ie your life is at risk because you would be targeted specifically in the other country. I am sympathetic of not wanting to move out of the UK, but what...

Re: unmarried partner visa vs fiancé visa

I'm worried we won't qualify for this. You don't. You are not permitted to 'live' in the UK on a visitor visa. I suspect you have been incredibly lucky to be allowed back in after each visit to the US as you been, in effect, living (contrary to visitor visa rules) in the UK. Have you been working? ...

Home Office immigration flawed, surely not. The very idea it is less than perfect may have crossed a few of the minds of the people using this site though 🤔
Agreed. In addition, it is outrageous that different countries have different rules/ laws, no?

And of course come back with specific questions.

And she may need a TB certificate if Thailand is a TB country, which I do not know if it is or not, but you would want to look out for this.

That letter is commonly sent out to FLR(FP) applicants. It means nothing abut what the outcome will be or when you will hear.

It may be that no one has a similar history who has come across your thread, as your situation is NOT common.

It's just a waiting game and might go either way...

Good luck.

Hello,

I don't think the OP realised that his first wife sponsored his visa to the UK and this sponsorship cannot be shifted to the second wife the way he was planning
Coincidentally, that was the advice he was given... just saying!
