C'mon people. Don't get worked up too much. What is done cannot be undone. It is just life. We all make mistakes. My best advice to Martha would be just to simply get on with her life. Although it may be difficult to forget about this but I think there isn't much point of dwelling on it for too long...

Re: What would you do? In desperate need of honest advice

Fish what out? The fact that immigration rules change all the time? You understood what I asked. Rules change all the time but that does not mean that in 2010 the permanent skilled migration programme that has been there for decades will cease. In fact the Government has been increasing the number ...

Re: What would you do? In desperate need of honest advice

One further word of warning. There is no guarantee that in 2011 Australia will be as open to migration as it is today. Consider that carefully if you can get a permanent migration visa right now. Wondered where did you fish this out JAJ? Furthermore, once he qualifies for a permanent visa, his situ...

I echo everyone's thoughts here and myself moved to Australia 6 months ago from the UK, where I wasted over 9 years fighting the beauracratic and arrogant British system. British citizenship does not have a lot of advantages as compared to Australian one. With both passports you can enter any Europe...

If you had mentioned to immigration that he had a second wife, he would have been refused to enter, I believe. Furthermore, bigamy is illegal in the UK. I don't believe that he would have grounds to remain in the UK beyond October 2008 unless he applies in his own right, as an established businessma...

The grant of LTR triggers an entry to be opened on CID giving the reason for granting the leave to remain, location, microfilm number (yes they do archive the landing card with LTR) and also the home office reference number(s). It does happen, Jeff. Not always, but sometimes it does Paul. When I en...

I would think that a file would have been created from that landing card. Not necessarily Paul. Unless there are reasons for doing so, for example, filing the documents, they don't normally do so. There are millions of people coming and going. Everyone must fill in the landing card at arrival. This...

I have given Bhaju by ppm my opinion in detail on how I believe she should proceed. Bhaju, I also told you re landing cards, which answers Paul's concerns. Perhaps it might be wise to first sort your and your siblings situation out (by giving yourselves a few years to accomplish this) and then move ...

1. Won't the Home Office refuse because of the deception in using forged documents (effective from the 29 February)? I know it specifies HSMP but some caseworkers might have a hey-ho approach to applying this before April. Or am I rambling..? The HO will refuse if they have evidence of fraudulent d...

Hey

Replied to your pm, but my message got stuck in my "Outbox" and did not go to the "Sent" folder for some reason.
If you have not received it, please send me your email address via ppm and I will re-send the message.

Cheers

Re: Crisis concerns!

do we have to pay off loans before trying to move? Immigration won't bother about your UK financial commitments. But you should sort it out in the UK before living. Either pay them off or go into DMP or declare yourself a bankrupt. Your UK credit history will not have any influence on Australian on...

The HO has been taking a bit of a battering over the legality of COAs. Maybe the OP wants to have another go at them. I think it would be just waste of time trying to fight the arrogant government system even if the HO were wrong in law. In my case, it took me nearly 9 years although the story was ...

The key issue here is that she will still have to leave the country and COA will not be granted.

The easiest solution in this case if simply go to Russia and get married there and then make all the plans for relocation to the UAE from there.

Suggest you sit tight for another 2 weeks and wait.
Then write to Appeals Directorate Customer Focus Team in Advance House in Croydon. They will sort this out within a few days.

I am afraid there is almost nothing can be done about it. He/she has been in the country very short time and has been found in breach of working conditions and also overstaying. The best option is to leave in his own accord, if it is still possible. Getting bail may be difficult because there are te...

I agree to all the above valuable advice. Nothing much to add except a few things to clarify: - Have you ever come in contact with Immigration Authorities in the past 15 years? Or have you been clandestine stayers ever since? - Do you have a Home Office file and reference number? - Do not volunteer ...

Hey, yes we truly enjoyed your story but still sorry to hear the outcome. Yes you have breached the workpermit conditions and there is nothing much you can do than to accept the decision and leave the country. It is not relevant why you breached your conditions, what is relevant is the fact. At the ...

I have to agree with SYH here. It is unusual for the HO to act just like this on someone's telephone call. It could have been nuisance or slender. If they had received such a call, the correct procedure for the caseworker would have been to refer the case to someone's from LEO to arrange for an inte...

The help that MP can provide you with is very limited - the best they can do is to write to the MP Correspondence Section and await a response. The response can take anything between 1 and 6 months and will only reiterate the status of your case. Nothing will change. If you take a matter in your han...

The OP hasn't mentioned what was the "fee fetching errors" as reported by the HO... Without which I believe it will be very difficult to appeal / argue about his case... Correct. If the Home Office were unable to collect the payment due to their own problem, then this is a complaint matter and they...

I think it is not a matter of appeal, rather it is a matter of complaint. Home Office errors is not your responsibility so you should take it up with the relevant managers there. Suggest you first approach BIA Customer Focus Team about this problem. It is good that your MP has written, however, expe...
