I have to agree with SYH here. It is unusual for the HO to act just like this on someone's telephone call. It could have been nuisance or slender. If they had received such a call, the correct procedure for the caseworker would have been to refer the case to someone's from LEO to arrange for an inte...

The help that MP can provide you with is very limited - the best they can do is to write to the MP Correspondence Section and await a response. The response can take anything between 1 and 6 months and will only reiterate the status of your case. Nothing will change. If you take a matter in your han...

The OP hasn't mentioned what was the "fee fetching errors" as reported by the HO... Without which I believe it will be very difficult to appeal / argue about his case... Correct. If the Home Office were unable to collect the payment due to their own problem, then this is a complaint matter and they...

I think it is not a matter of appeal, rather it is a matter of complaint. Home Office errors is not your responsibility so you should take it up with the relevant managers there. Suggest you first approach BIA Customer Focus Team about this problem. It is good that your MP has written, however, expe...

Never heard of that. From my personal experience, I can definitely say that The Netherlands, the UK and Sweden do not require this. I am being a non-EU citizen, have been passing through airports in Amsterdam and Stockholm before catching a connecting flight without having any Schengen visa at all. ...

So if the germans don't check transit passengers, what's the point of transit visas? Or is there something I'm missing here? Transit visas are only required when you want to leave the airport terminal for some time before returning to your connecting flight. If you remain within the terminal, you d...

I meant those with Discretionary Leave who can apply for ILR after 6 years.

Given that germany requires transit visas for some nationals, wouldn't it make sense to check transit passengers as well? It would if he wanted to go out the terminal for a few hours or a day before catching his connecting flight. But he remained within the terminal and never crossed the German bor...

This is why so many people are leaving and not thinking of going back. Australia is not paradise but a hell lot better and lifestyle is more relaxing. Rules are simple and straightforward. If you qualify to become a resident, you get it straight off without beating about the bush for 5, 10 or 14 yea...

This all sounds strange to me. If you were coming from a non-Schengen state and going into a non-Schengen state, you should not have been directed through the Schengen passport control. You should have been directed to a non-Schengen terminal where you would have been waiting for your connecting fli...

Hiya Jeff, would this still apply after the new rules on overstayers??? Who knows - as you see from the recent posts above that they are clamping down on illegals now and more regular checks are being made. if we leave and are not caught can we come back after the 1 year or 10 year still confusing ...

I think all you have to do at this point is just simply wait for the hearing. Have you provided evidence that you could support yourself without public funds? Your English may be a problem as far as employment is concerned, which you need in order to satisfy the maintenance requirement for the visa....

It is difficult to speculate about this but I honestly believe that when they refer to "deception" they mean something substantial that already happened and the proof of it is available, for example, obtaining a visa by deception, then being caught and having the visa curtailed/cancelled and removed...

Up until 2004, UK residents with leave to remain for longer than 6 months did not have their passports stamped when leaving and reentering the UK. The only stamp they got was the first one when they first entered the UK. Yes, but that does not negate the fact that there should have been an immigrat...

Re: Was I an illegal entrant?

happened, but I suspect I might have accidentally 'skipped' immigration control when I returned to the UK. Close to impossible. and there was probably no immigration control when I reached Manchester because it was a domestic flight, so I was herded straight out of the airport on arrival. You shoul...

Can someone please provide information on whether any changes are being made as part of the recent/current overhaul of the immigration rules to the 14-year rule/concession? Unheard of so far. Don't think there will be any (no point in my opinion) Also, in addition to the usual good character/no cri...

No, there are no standard forms to apply for concessions, because these are applications outside the Immgration Rules. However, there is SET(O) form that you can use for this purpose. You need to familiarise yourself with the Home Office DP3/96 policy and write a properly written letter and submit t...

Hi

Your stamp is the main evidence of your arrival and time you spent in the UK. I am not even sure if they accept any other form of evidence except for your passport. Make sure you keep all your passports, even old and expired.

All the best

If I am applying for ILR based on 10 years and gets refused (metaphorically speaking) whilst current leave to remain is valid for another year, can I apply for ILR again at the end of that year to gain advantage of the chance of appeal? Yes or the initial application refusal would reset the clock 1...
