vinny thanks sorry for asking single question at a time, my wife came in June 2011 as a Work Permit dependent, we only transferred to Tier 2 in Dec 2012. Does it means that since she became Tier 2 dependent after July 2012, she would have to satisfy 5 years rule or the Work Permit dependent leave wi...

But if she failed to satisfy the language requirement, can she still apply at the same time as i do, or would she have to apply separately on a different category? She may apply for the relevant extension if she does not qualify for settlement. can she apply at the same time as i apply for ILR i.e ...

vinny i mistakenly thought that wp and Tier 2 dependent categories had the same requirements. Apologies. My wife joined UK as (my) WP dependent in June 2011. Back in December 2012, we both transferred to Tier 2 visa (with a new employer). In November 2013, i would have had over 4 years WP and a year...

uk_2010 & vinny I am currently under Tier 2 g and have leave till 2016 (same for dependent) I can apply under Long residence in July 2013 but as per rules, I don't think my dependent can apply with me under this category until I receive my ILR, which will take till December 2013. However, I will be ...

ILR or FLR for Dependent !

I will be applying for ILR (WP category) in November 2013. I am aware that my wife (joined me in UK in June 2011) can apply at the same time then but if she is unable to pass the Life in the UK test by November, can she still apply at the same time as me. If not, what category can she apply for and ...

Thanks uksettlement, I personally like the idea of PEO application, its just the feeling you get with UKBA that they change laws for ILR. Also, i switched employers 2 months ago, how important is the acknowledgement letter for holidays taken for the 4 years period i was with them. I have an absence ...

ILR (Tier 2 or 10 Years category)

I will qualify to apply for ILR on 23rd July 2013 under 10 year category and on 19th December 2013 on 5 years Tier 2 category. I know the basic requirements for each but i am looking for advice on which category is straight forward to apply in (in terms of documents required to be submitted with eac...

They should have returned your original documents. THanks again Vinny. Is there a preferred way of requesting these documents back. Also, my last Tier 2 application (Feb 2013) was a variation to an FLR O application (Dec 2012) for which no biometrics were ever requested. But i was charged twice (Ti...

Re: Tier 2 to ILR - 5 Year rule

I would personally like to apply PEO but not sure whether PEO service is available for Long residence application. No . Also, my wife (married in Oct 2010 back home) who joined me June 2011 in UK, she would have been with me here for over 2 years when i apply for ILR in september or december. Can s...

Re: Tier 2 to ILR - 5 Year rule

28 days before your 5 year anniversary of being on a Tier 2 visa. So Nov/ Dec 2013. Your time under Tier 4 visa does not count towards your 5 years to ILR. Thanks for the info. I Will qualify for 10 years long residence in September 2013. What would your and other Experts on this forum, that which ...

Tier 2 to ILR - 5 Year rule

Hi, I finished my studies my masters in Summer 2008 and was offered a job with 4 year work permit in December 2008. The job though, started in September 2008. My student visa was originally valid till December 2008, so the UKBA issued the work permit from December 2008 to December 2012. I now have a...

Application varied from FLR O to Tier 2, Charged twice

All, I applied under FLR O category as my work permit was running out just before Xmas 2012. I found a tier 2 employer and varied the original application to a Tier 2 application as no decision (or bio-metrics enrollment invitation) until now, but i was charged again twice. I was told to expect to b...

Switching FLR-O to a Tier 2 Application

I applied for Flr O end of December 2012 for which I haven't heard so far. I was on a work permit for previous 4 years until Dec 2012 and have been in the UK for 9 years 5 months in the UK. Previous employer didn't give me enough notice in telling me that they wont be renewing contract, so I was adv...

Well yes, I can vary it... Surely it's better than withdrawing FLR-O application. I don't have confidence in Discretionary leave route as each caseworker will see a case differently. I really need an expert advice on this matter...

Common folks, a bit of top advice ?

Well my solicitor suggested that we go along discretionary leave (FLR-0) route and either vary the application or withdraw FLR-O and make fresh Tier 2 when ready. I know in my case that I will be ready to apply for Tier 2 within 2.5 weeks of current leave expiry. So assuming i submit on 17/12/12, i ...

Work permit expiring/becoming overstayer and ILR !

Hi, I have been a work permit holder for past 4 years with current visa expiring on 19/12/12. Current employer did not tell me until 2 weeks ago that they will not extend my visa. Meanwhile i have an interview with a Tier 2 sponsor lined up and I am a strong favourite (i say this because i already h...

Work Permit - Umbrella company (Spam 8). BEST AVOIDED

Respected forum members, I have a work permit that runs out 19/12/12. Current employer is not looking to become sponsor and that doesnt leave me many options. I have contacted Spam 8, they are willing to sponsor me on a contractor basis as i have been offered a position (from a company who also isnt...

Re: Current W/Permit Expiring-New Job offer but no Sponsor

Point taken with the SOC salary.
With regards to RLMT, if the job wasn't advertised as per requirements does that mean that the employer will have to conduct the whole recruitment process again?
This isn't looking as promising as it did when they called me up to offer. Damn this sponsorships !

Re: Current W/Permit Expiring-New Job offer but no Sponsor

The salary does meet the SOC requirement.

I am confused regarding the shortage occupation list.
I am a mechanical and aerospace engineer academically and the job on offer is of production planning manager (in engineering dept. offcourse) within a railway company. Is/could there be a link ?
