Re: Resident Labour Market Test Proof

You do not need to submit any proof of RLMT with your visa application. Your employer will have to provide reference numbers to the HO during CoS allocation stage. They must also keep the proof of advertisement in their records for at least one year.

Re: Tier 2 with Disabled Kid

Having an EHC Plan is not classed as "recourse to public funds". Children of legally working migrants are entitled to free school education. Your child should get an EHC plan depending on her needs and how well you present your case to the LA.

Re: Tier 2 with Disabled Kid

We have tier 2 ICT visa which states no access to public funds I see in the response, someone said there would not be any issue in accessing the education or healthcare. Healthcare is provided by NHs and we all entitled for it. We have a child with special needs and we are struggling to get her in ...

Re: Tier 2 General to ILR - Dependants' Eligibility

Thank you for clarifying that, CR001. Has this rule been changed recently or has it always been the case?

My understanding was the visa issue date starts the qualifying period for both the main applicant and dependants.

Tier 2 General to ILR - Dependants' Eligibility

Hi, I will be applying for ILR based on 5 years on Tier 2 General visa in March 2018. I am a bit unsure about my wife and children's eligibility date. Our timeline is as follows: Entry Clearance issued for the family: 24 April 2013 Main Applicant entered UK: 26 May 2013 Dependants entered UK: 09 Jul...

Tier 2 General to ILR Salary Concerns

Hello all, I came to the UK in May 2013 as a Software Developer on 26K salary. I negotiated and received a 6K increment in January 2016 raising my salary to 32K. This increment was not reported to the HO via SMS because my employer was under an impression that only salary reductions are to be report...

As djsucess mentioned the salary limit is 29,600 for soc 2136 ?
Is it not 31,100?

Thanks.

It is £31,100 not £29,600. Check here.

Re: 2013 Tier 2 General eligibility to ILR /PR in 2018

You must be earning £35K a year at the time when you apply for ILR. You will have to demonstrate that by submitting your latest salary slip, corroborated by your latest bank statement showing a matching transaction. A letter from your employer cannot be used to bypass this requirement. The £35K sala...

Tier 2 migrants are not allowed self-employment so you are indeed in breach of your visa conditions. Presuming that the agency is paying your company B2B instead of paying you via PAYE.

No need to notify the HO of a pay raise. However, any reduction in pay must be reported.

Tier 2 Licence Renewal

Our Tier-2 Licence is expiring in November this year. My employer applied for renewal on 19/09/2016. We checked the SMS for progress today and the information provided is a bit confusing. On licence summary page, it says expiry date 11 Nov 2020. Whereas, the application status page shows the applica...

Re: Do this documents require for extension?

Provided you're working for the same employer under the same SOC code, you only need to send your current passport with your visa affixed or BRP if you have one and a passport photo, same for your dependents.

Yes, for all work visas you have to get your passport stamped from Protectorate of Emigrants office. If you fail to do so, you might be stopped at the airport and denied boarding.

Tier 2 General - Salary

Hi, Just a quick one. Once a Tier 2 General visa is granted, does a migrant's salary need to be continuously reviewed in order to stay in compliance with code of practice? Or can the employee stay on originally agreed salary and only needs a raise if code of practice demands so at the time of an ext...
