Re: Exercising treaty rights

Same scenario here. Me and my British wife have been here in Germany for almost a month and half. I was given a Family Member of an EU citizen visa. On arrival in Germany we had to find a place(which took about 2 weeks). After we got the rental agreement, we went to the Stadamt for Registration. Once...

Re: New EU deal: Free-movement rights gone?

OK, so after reading all this I'm starting SS in 2 weeks, what are the possible outcomes/sceninarios if the non-eu family members receives the host member states residence card before the referendum?

Re: Does the latest new EU Deal bring any effect to SS route

What would happen to people who are already in their host state or are going to be in their host state before the referendum?
Surely, if they have been been issued Schengen visas or Residence cards on the basis of freedom of movement, they can continue with their SS route under the current rules ?

Re: UK EU IN OUT REFRENDUM CONFIRMED SUMMER 2016!!!!

So would it be wise to do a SS in 2016 if the referendum takes place in June/July or even autumn?
Any setbacks/suggestions??

SS Query

Dear members:
I'd like to know If you are paid in cash would a letter from the employer confirming the employment plus monthly payslips be sufficient enough to apply for FP or do we still have to provide the bank statements showing the money coming in??
Any thoughts anyone ??
Thanks in advance :)

Re: Please answer -SS Family Permit and Income

I remember reading one of the posts where a person was refused a FP because the income earned was less than 150GBP per week. Perhaps, the Home Office is applying the "Minimum Earning Threshold for EEA workers" to SS applicants. Now, whether they should apply this to SS applicants is another question?...

Confusion about Right to Work

Dear members,
I would like to know if a person is still allowed to work after the EEA2 application has been refused but is in the process of appeal.
Note that the COA issued at the time of EEA2 application gave the right to work.
Any answers would be appreciated.
Regards.

Re: Questions regarding Surinder Singh Route via EEA family

Thanks for your help, so as I understand it isn't necessary to register the birth with the UK authorities and with the added time in this step won't speed up the overall process. Does anyone know as I have been British from birth with British parents/grandparents etc. should this whole process be q...

I am familiar with the 'service provider' that you mention. If you feel you are unable to find a property and job then i'd say possibly they are an option to consider , otherwise your free to ask for help on here. Hi St244, With regards to the 'service provider' I can see some banners going on this...

Re: Can I get Code 1A (EEA dep) stamp and then EEA2 for my w

Technically yes although in Surinder Singh cases, my recommendation would be to go for Family Permit to ensure you got the required documents and satisfy the HO. You don't want to get refused for a EEA2 application after you moved back. Would an EEA2 application for S.S cases be successful if someo...

I was wondering if a RC from member state is necessary in order to apply for a FP or EEA2. If it isn't would it make any difference to FP or EEA2 decision made by UKVI?

I disagree. Surinder Singh door can't be shut as long as the UK remains part of EU/EEA.

Re: Young couple need help/options to live in UK - EEA route

If its Surinder Singh route you want to do then you need to act fast as the referendum would most likely be held in 2017 and no body knows what would happen after referendum. I'd also like to say that other people who want to do SS route consider doing it before the end of 2016 due to uncertainty of...

Re: Is this EE4 refusal justifiable?

The regualtions regarding continuity of residence are quite vague.
It's still not clear whether a person who stays out of the country for a period of upto 12 months is allowed to take subsequent absences of up to 6 months in future without affecting the continuity of residence.

Re: Is this EE4 refusal justifiable?

But Regulation 3(2)(c) does not seem to be ambiguous . It appears to provide for one absence of up to 12 months. Further absence will appear to break the continuity of residence. Also going by the caselaws, he may pray in aid to Babajanov . Thanks for reply Obie. It seems to me that an absence of 1...

Is this EE4 refusal justifiable?

Dear members, A friend of mine had his EEA4 refused on the basis of continuity of residence. His timeline is following: EEA2 issued: Jan 2010 Feb 2011-Dec 2011:Moved to US for studies (11 month absence). August 2012-October 2012: Left UK for a holiday. Jan 2013-March 2013: Left UK for a holiday. Mar...
