Are Interns considered as workers under EU law

Dear members,
I would like to know if a person would be classed as a worker if he/she is doing a paid/unpaid internship for a duration of about 5 months.
Any replies would be highly appreciated.
Regards.

Re: Visa free travel for Residence Card holder Case refer to

This was posted on one of fb groups: This is from an email that one of my friends received from Europa advice after asking if they could travel to the UK without applying for FP. They traveled to the UK on New Years eve without any problems. Didn't even get asked any questions at the boarder. Just s...

Re: Surinder singh under student route

Thanks for your reply. A friend of mine had his FP approved under student category recently even though it was refused initially. So i guess it's possible to succeed under C-456/12. I was wondering what documents would be required if someone wanted to apply under self-sufficient category? Also: http:...

I note that you mentioned that your wife previously entered the UK with a German residency card so I just wanted to ask you whether your wife encountered any problems when she travelled from Germany to UK using the card as from what I understand people doing s...

Everything depends on your partner's nationality. Is your partner an EU national and if so,which country is he from?

unused schengen visa

A friend of mine has been issued with a schengen visa but unfortunately he won't be able to travel as some unexpected things came up.
I would like to know that if he doesn't use his visa will it affect his future applications as he doesn't want to jeopardise future applications.
Many thanks.

Re: Travel with Residence Card - Success Stories

@Donutz : Thanks for your post. From your post it is clear that a person won't have any problems travelling within the Schengen if they have been issued with a residence card from another Schengen state and it doesn't matter if they are travelling with or without their spouse. However, would a perso...

Re: Surinder Singh Route Questions

Hello, my Family and I are currently living in Germany. I'm British and my husband is American. We have lived here in Germany for about 7 months now, after moving here as a last resort just to be together. Recently we heard about the Surinder Singh route and thought that might be a good option for ...

I was wondering if a holder of Residence card issued by Schengen country can travel visa-free to other Schengen states without being accompanied or joining the EU citizen.
Any replies would be appreciated.

Re: Surinder Singh Route Questions

The good news is that according to the judgment on Case C-456/12 a person can be in self sufficient category in order to trigger rights for their non-eu family member to return back to the home state of the eu-national. But the bad bit is that UK hasn't amended the regulations yet which means that y...

Re: Spouse of EEA citizen: Entry with Schengen visa

My wife is British. We are living in Shenyang.
We will be travelling together so I guess a one-way ticket should hopefully be fine. I really don't fancy paying for a return.

He was also never asked anything when he entered Amsterdam on a tourist visa. I was behind him every time but they never once looked for me. I'm sure the UK is different but Schengen countries don't seem to be so worried! Chaoclive could you please tell us whether your partner had a return ticket o...

Re: Permanent Residence Question

I have heard that 6 months continuous absence is enough to break residence, never mind 12 months! I'd always thought that single absence not exceeding 12 months is fine for important reasons. However, I'm not sure if one can be away for short visits to other countries after being away for 12months....

Re: Permanent Residence Question

Would the continuity of residence be broken if non-eu and eu partner both left the country for 12 consecutive months for study. The only person who will be studying would be the non-eu partner. Also after being away for 12 consecutive months, would a person be able to go on short holidays which woul...

Confusion regarding continuity of residence

Dear members I was wondering if some one could explain the continuity of residence according to the directive. As far as I know a person is allowed to be out of a member state for upto 6 months in a year. However, a single absence is allowed for 12 months for important reasons such as study, militar...
