Re: FLR(M) extension - can we use a Travel document instead of a Valid Passport

Why would the Indian Government not renew your sons’ passports? India allows children to keep Indian nationality until they are 18 when they can choose. How old are your sons? The Indian government has recently changed its interpretation of the law (I believe, but am not sure, that there has been n...

Re: EU Citizen Settled Status, spouse and baby abroad

No I had not lived with him as I was studying at the time and working. We were doing long distance and with COVID we couldn't get married prior to December 2020, even though we were Islamically married in 2019. Which I know isn't plausible under UK law as 'married'. OK. In that case, you'll need to...

I think so too. I was just thinking out aloud and exploring that possibility.

That is to say that they left the UK on their own cost and they didn't have to be deported at taxpayer expense.

If you have ILR, presumably you were not deported at taxpayer expense.

I think the wife and step-children need the marriage to have lasted more than three years, with at least one year residence in the UK to qualify to retain the right of residence in the UK. But wait for others to advise.

Re: EU Citizen Settled Status, spouse and baby abroad

I got married to my non EU husband in June 2021 but had been with him since 2018 but still lived in the UK. Did you live with him in "a relationship akin to marriage", with shared finances in the same place, for at least two years before 31st December 2020? As for your son, I think you will need to...

If your husband was a British citizen on the date of birth of the child, then the child is automatically a British citizen.

Apply directly for a British passport.

Re: British Subject to British Citizen 1949

This is an interesting question and I have gone back and forth on it, as it is not quite that straightforward. To start with, the first thing to understand is that there are two underlying requirements for somebody born before 1st January 1983 to have become a British Citizen on that date. They need...

Re: Citizenship Ceremony: Do I wait?

Each local council does its citizenship ceremony procedure differently (the citizenship ceremony itself is broadly the same in all). Some contact you first, some expect you to contact them. Some will give you a fixed date with no flexibility, some will allow you to choose from a range of dates that ...

Re: citizenship queries - residency

i do not have any other proofs available such as p60 or gov letters You'd essentially need to get a few of these. Because you are the spouse of an EEA citizen, there is a good chance that your passports were not stamped on every visit to and from the UK and therefore they can't be sufficient proof ...

The proof that is acceptable is generally correspondence...

Re: 10 year Parent Leave - Dependent Child Costs

Since you arrived in the UK in October 2015, you would be eligible for ILR Long Residence in October 2025. Presumably, your ex-husband would be eligible for the same either at the same time or earlier than that. Since Child 2 is born in the UK, they don't need ILR. If you renew their dependent visa ...

Keep in mind that the onus for visit visas is not on the sponsor, but on the applicants. You (the sponsor) should be able to show that you can accommodate them (without overcrowding) and that you can help them financially while they are here. But the onus is on them to show that they can afford to c...

Re: Do we have the possibility of switching?

This is the second time renewing now, so 5 odd years done. Even if you switch to the FLR(M)/spousal route, you will not benefit in any way. Your husband will need to spend five years on the FLR(M)/spousal route in order to qualify for ILR. That clock will therefore start from zero when he switches ...

If both parties are dual British-Pakistani citizens, the divorce can be in either the UK or Pakistani courts. But there needs to be a judicial/legal divorce, with the legal paperwork to prove the divorce. The divorce needs to be finalised (by a decree absolute in English law, if divorcing in England...
