Re: British Citizenship for UK Born - T FORM OR AN FORM?

What is your current immigration status in the UK? Is it ILR? If so, when did you acquire it? I believe that both Form T and Form AN could be applicable. Firstly, you say that you had left for a family vacation on 23rd March 2005 and returned on 3rd September 2005. That is a gap of 164 days (as per ...

Re: urgent family migrated in 2006 please help

Living in the UK does not entitle you to ILR. For the younger children, they may issue FLR for a period of 2.5 years, renewable four times. You could then get FLR on the basis of being their parents. But ILR is atleast ten years (of legal residence) away, assuming that rules do not change in the mea...

Re: Child Born in UK - Citizenship Queries

In one of the post you said , there might be issue traveling on Indian passport and returning on British Passport, is that legal issues? Can it be sorted? Th issues that I refer to are issues with the Indian authorities. I believe (I could be wrong) that somebody in that situation may need an exit ...

Re: UK EU IN OUT REFRENDUM CONFIRMED SUMMER 2016!!!!

While the EEC turned into the EU in 1992, its character is turning more into a unified political state with each treaty since Maastricht (Amsterdam 1997-99, Nice 2001-03 & Lisbon 2007-09). It has been argued that the Lisbon Treaty was the same as the proposed EU Constitution and that it was implemen...

@CR001, if the OP and her boyfriend have stayed 20 months together in the UK, can they do Surinder Singh with just four months in another EEA country?

Re: Switching from Tier 4 to spouse visa with little time!

As others on these forums will attest, the Home Office helpline is not wholly reliable when it comes to immigration advice. I would not rely on it.

Re: Switching from Tier 4 to spouse visa with little time!

Why have you not married and sorted this out earlier than now? He proposed at Christmas The boyfriend, being a British citizen, probably had not realised how convoluted and strict the Immigration Rules are. I concur with CR001 and Casa , given that the visa expires in four days time, it would be be...

Re: Switching from Tier 4 to spouse visa with little time!

The notice period for a marriage where one of the participants is a non-EEA citizen can be extended by the Home Office to 70 days.

Also, you must give notice in a Home Office designated registry.

This means that the applicant: (a) will leave the UK at the end of their visit; and (b) will not live in the UK for extended periods through frequent ...

Re: 18000 - Europe national

Not if you are a solely EEA citizen living in the UK.

But if you have British citizenship (not PR) as well as EEA citizenship, then yes, you do. And then, the amount is £18,600.

Re: Child Born in UK - Citizenship Queries

1) Can I apply for Registration for my 2nd Child (Skipped ILR/Visa etc.,) before they leave ? Yes, as the child was born in the UK. 2) Can he give the bio-metrics in our home country ? 3) Is it better to give bio-metrics and then fly to India ? The child's home country is the UK :) The latter optio...

Re: UK EU IN OUT REFRENDUM CONFIRMED SUMMER 2016!!!!

The EU will be a laughing stock if it allows the UK to undermine it's founding principle and impose breaks in movement of people . It will merely be reminding the EU that it started as an economic community and that is the way that some people wish to keep it. Ever closer union is not welcome to al...

On that basis , even though their heart may lead them to say no, their head will hold the contrary view and I am sure their head will prevail. Much as I wish I could agree to this sentiment, I feel we both will be disappointed. It has been hypothesised that we live in a "post truth" era, where peop...

Re: UK EU IN OUT REFRENDUM CONFIRMED SUMMER 2016!!!!

I don't think UK will leave. I predict a stay as well, but with significant concessions on immigration. Immigration is what will sway the vote and the EU can not be blind to that. I also think that the Syrian migration crisis will focus minds within the rest of the EU. Look at the spectacle of Pola...

Re: UK EU IN OUT REFRENDUM CONFIRMED SUMMER 2016!!!!

Nevermind the fact that immediate freeze will be illegal without an act of parliament repealing the 1972 European Communities Act. I meant that a vote for Brexit could be interpreted as a signal to the UK Parliament to repeal the European Communities Act 1972 with immediate effect. It would be hard...

Re: UK EU IN OUT REFRENDUM CONFIRMED SUMMER 2016!!!!

It seems October 2016 is likely to be the date for the referendum given the fact that House of Lords has granted 16 and 17 year olds the chance to vote. http://www.theguardian.com/politics/2015/nov/18/lords-back-eu-referendum-vote-for-16--and-17-year-olds That news is slightly stale. Re: Registration for BC for ILR dependent Children

The status of children born outside the UK is in-line with that that of the less-privileged parent (either mother or father). Their registration as British citizens is at discretion, which means that the SSHD/Home Office can impose any conditions that they think fit. Currently, children born abroad ...

Where was your daughter born? If your daughter was born in the UK, she is entitled to register as a British citizen and does not need ILR. If your daughter was born outside the UK, she will need to apply for ILR and can only be registered after either both parents have become British citizens or one...

Re: UK EU IN OUT REFRENDUM CONFIRMED SUMMER 2016!!!!

There could be changes to the Treaties even in the absence of a vote to leave the EU. It is not improbable that a part of a successful renegotiation before the referendum is a protocol modifying the EU Treaties giving the UK a derogation from specific provisions of EU immigration laws. In other word...

Firstly, the last query has nothing to do with the original query. Can the mods detach it into a separate thread?

Secondly, was the child born before or after the parents acquired PR by exercising five continuous years of treaty rights?
