They will need to switch visa and apply on FLR(M) and meet all the requirements, English (for spouse) and Financial. As far as I know, it is up to the Home Office to prove that I am not eligible for naturalisation so the fact that they destroyed my file shouldn't be an issue. It is actually the other way round. Good spot. At almost exactly a year between hearing and judgment, it is one of the longest pending cases in UK Supreme Court history (which of course only started in 2009).

The complicating factor is that Chinese law automatically considers people of Chinese descent living in Hong Kong as Chinese citizens. Hence, BNOs of Chinese descent can not register under any section of British law that requires you to hold no other nationality. So, it comes down to your ethnicity....
