Re: Is Right of Abode settlement or non-settlement?

I think an administrative review would suffice in your situation, but I do not know how long it would take. How come Immigration officer have no knowledge in India regarding Right of abode ? RoA requires a person to have multiple citizenships and to never have held a British passport before. That co...

Re: Made Redundant

As you are on Tier 1 General, you can apply for another job.

If you were on Tier 2 General, I believe that you would have to leave the UK. So, count your lucky stars.

When did you apply for your initial Tier 1 General application and was that in-country or out-of-country?

Re: Please advise on Child registeration

Should I just post the application to passport office directly or use the check and send service I would suggest sending by post. I would also suggest not sending your PR card as that would also confuse the Home Office Caseworker. Just the passport form and the evidence that was submitted for the P...

Re: Please advise on Child registeration

I spoke to HMPO and they advised that automatic automatic acquisition of PR using treaty rights is only applicable to EEA citizens. The Home Office phone lines have been known to give incorrect information. You may have confused the person by specifically asking about Non-EEA citizens. Noajthan has...

In PH there are varying degrees of husband. Fifty shades of grey...errr, husband? :D is a CENOMAR a requirement for a child's passport? You are going to have to translate that. Apart from Noajthan , most people on these forums are not au fait with Filipino legal terminology. The precise legal statu...

Re: Can EU/UK law change to cut down immigration figures?

If free movement for EEA citizen still stands, Not allowing them to bring their spouse and children sounds a little inhumane... isn't it? If it is inhumane, they have the freedom not to come to the UK :) Nobody is compelling them to. Also, nobody is suggesting an absolute bar on spouses and childre...

Re: ILR for children

I believe that FLR(FP) puts your family on a 10 year course to ILR (11 to citizenship provided the applicants remain of good character throughout). If your children are not born in the UK, their status will be in-line with the less-privileged parent. Under UKV&I's current policy, they cannot be regi...

Re: Is UK Doing Enough to assist with the EU refugee crisis

Also, now with Jeremy Corbyn leading the Labour Party, we will now be seeing the Labour Party advocating for unlimited migration to the UK. Kate Osamor, the Labour MP for Edmonton, said on air that she would have "no number" on the number of refugees to be allowed into the UK. She did quickly qualif...

Re: Is UK Doing Enough to assist with the EU refugee crisis

I wonder if Germany and Sweden discussed their "if you can get here we'll take you in" policy with any other EU nations. It ignores long-standing common-sense international policy on refugees. Indeed, Germany has thrown the equivalent of a Facebook party in a shared house, some of whose rooms doe n...

Re: EEA Family Permit (UK citizen in Saudi with Thai wife)

As a British citizen, you can not exercise treaty rights in the UK. You can only exercise treaty rights in an EEA country of which you are not a citizen. Hence you are ineligible for an EEA family permit. You will need to apply for a Family of a settled person visa under the UK Immigration Rules. If...

Re: Can EU/UK law change to cut down immigration figures?

Probably not what you want to hear, but let me give you two additional points to ponder over. a) The UK has pretty much tightened its own immigration rules to the point where it is suffocating universities and businesses. The only major route that it has not touched so far (because it can't) is the ...

Your Russian partner can travel to any country within the EEA except the UK, provided she is either traveling with your son or traveling to be with your son. She gets no rights of her own, but is dependant on her son who has the freedom of movement across the EEA. Would a UK 'family of a settled per...

five, four, three or two That is not a countdown. Different categories for ILR require proof for different numbers of years of residence in the UK. So, five years for Tier 1/2 G, fours years for HSMP, three & two for Tier 1 Entrepreneur/Investor. So, if you are applying on the basis of a T 1/2 Gene...
