Re: British overseas citizen how to get ROA,ILR or full citizenship

I would say that, right now, you are in a considerable amount of what the French would call "la merde". Mostly of your own making. Right now, you have no right to reside or work in either the UK or India. I think, at the very least, since you are still in India, you should look at applying for OCI (...

Re: British overseas citizen how to get ROA,ILR or full citizenship

Being a British Overseas Citizen may not give you any advantage over being an Indian citizen when it comes to moving to the UK. A BOC is subject to the same restrictions on living in the UK that an Indian citizen would be. When and where were you born? When did you apply for and when did you receive...

Re: Child born abroad. Naturalisation confusion

If a person is not born a British citizen, the only way to become a British citizen is by registration or naturalisation (adults only). There is no automatic acquisition of British citizenship at any time after birth. 2. If my daughter need to apply for Naturalisation, can she apply at the same time...

Re: Naturalization as a British citizen: The urgent and compassionate case under medical urgency, please.

Kindly following a professional independent legal advice received concerning the Home Office's responses dated in January and March, it is clear that the available courses of action are to file a formal complaint, request the imposition of a deadline (preferably within 10 working days), and pursue ...

Along with the request to remove the observation, I think you may have to state your reasons for the change. What arguments would you make for that request?

Is your Russian passport in a different name? Have you, for instance, taken out the patronymic from the name in the British passport?

Re: Child Born Uk - Not sure we can apply for British passport directly

A court can't/doesn't grant ILR. It may direct the HO to reconsider its decision or to grant ILR, but unless there is anything specific in the judgement, ILR is only prospective and only from the day that it is granted by the Home Office. Your child will need to be registered as a British citizen on...

I'd like to inquire whether someone with ILR status is permitted to work from their home country. Is this allowed? If yes How many days max? Not sure what the question is here. A person with ILR is allowed absence from the UK. Even if working abroad, it is still an absence from the UK and will trea...

Re: British by double descent

This is not true that "double descent" is rare or restricted to a few countries. The 1948 BNA allowed for what people call "double descent" in section 5, and now because of the 2022 changes to the 1981 BNA (section 4L), a lot of people are now eligible to register for it based on having a British g...

A passport is required to board an international flight or transport (ships). Only domestic flights (and intra-Schengen/intra-CTA flights/ferries are considered domestic for these purposes) do not require passports.

Re: Baby born in india

As a dual national I think he can hold both passports until he reaches 18. I think it is more nuanced than that. My understanding (and I could very well be wrong) is that Indian law allows dual citizenship , so long as the child does not have any non-Indian passport . So an Indian passport with a C...

Re: British by double descent

Citizenship by double descent is extremely rare and is, to the best of my knowledge, only possible under very limited circumstances related to the Federation of Rhodesia and Nyasaland (modern day Zambia, Zimbabwe and Malawi). And that is only because of an error in the drafting of laws governing tha...

Re: British passport for child born outside UK to British citizen with Australian passport.

You say your passport shows you as "British" - you mean "British otherwise than by decent" ? If so I believe your child is British by decent and entitled to a passport. If it says "British by decent" then your child won't be British. British passports for British citizens only state their status as...

British passport applications for British citizen children born on the Subcontinent are known to take between six months and a year.

How old are the children? Some advice us to apply for ILR for the children, while some advice us to apply child dependent visa. Are they the same route? If not, which route should I choose? The children can't apply for ILR directly and you should apply for child dependent visas for them. However, as...

Re: Spouse on ILR dependant VISA naturalization application without ILR

ILR is a requirement for naturalisation, even for spouses of British citizens. Since ILR requires a minimum of five years on the spousal route, that means that your spouse can only apply for naturalisation after getting ILR after five years. She would be able to apply for naturalisation immediately ...

In the past few years, the number of ADR visas issued has been in s...
