He may not, if he is traveling with his Spanish child, who will be the one exercising treaty rights (truly, the child is the father of man). He will need to carry proof of his relationship to the child. Otherwise, I believe he does.

Much better for him to apply for a free EEA Family Permit, though.

I could be wrong, but I think that 3C only applies to appeals to the FTT/UTT. JR takes the case out from the appeals system to the courts system and so, I believe that 3C lapses. But I could be wrong.

@sushdmehta, I am a bit hazy on the workings, but would Section 3C not cover the period while the OP applied to First-Tier Tribunal and the Upper Tier Tribunal even though he got a refusal from both?

You can apply 28 days in advance, but for LR applications, your clock starts from the day that you arrived in the UK, not the date of your visa.

So, the earliest you can apply would be 28 days before 20th September 2015.

I doubt that getting a tenant agreement "provisionally" (whatever that is) would be sufficient. Think about it.
