Why not write a letter to your local MP explaining your case? It does work sometimes. I doubt if it's possible to take HO to court. No I was not interviewed when I initially applied for tier 1.
Applied from outside UK. Received visa in 14 days without interview.
So I was shocked to receive the interview call at the time of extention.
