Second EEA1/2

I posted a question in the referendum section but this section might be more appropriate. Have been in the uk for 9 years, on our 2nd eea1/2 now till 2017. Question is, oir first eea3/4 was refused due to lack if self employnent evidence, what dies that make of our first 5yrs in the UK by law, were ...

Re: EU citizens RESIDING in UK

Thank you about the 10 years clarification. We dont have property outside the EU and my children only speak english (as opposed to Latvian) would that count as good enough reason? If the child get naturalised do we as oarents benefit from that as well? And with regards to our first 5 years of eea1/2...

EU citizens RESIDING in UK

Hello all Obviously with the brexit prospect coming closer, new fears have arisen for me and my family at least as per EU route. Having researched a few articles, even Nige himself said that EU cotizens residing in the UK should be OK, given ILR possibly and a few mentions to the Vienna convention, ...

Re: New EU deal: Free-movement rights gone?

Well, I think we have to understand why they didn't choose this: 'Non-EU nationals who had no prior residence in a Member State before marrying an EU citizen' but they chose this: 'Non-EU nationals who had no prior lawful residence in a Member State before marrying an EU citizen' If there were goin...

Re: New EU deal: Free-movement rights gone?

Please clarify how the supposed changes would affect an EU citizen who lives in the US and married an american. The EU spouse has never lived in Europe. Would the couple still be able to move together to any EU country (in our case Ireland) under movement rights? If the US spouse has never lived in...

Re: New EU deal: Free-movement rights gone?

If to take a step back and hink about it. They cant just backdate the new laws and apply them them to say noneu nationals who started their processes as in eea2/3s already. As this process leads to eea3/4 & pr. This whole process is obviously a settlement solution for us. Settlement as i. Living, wo...

Re: New EU deal: Free-movement rights gone?

No one knows the precise implications at this stage in regards to David Cameron's EU deal. However we know that the deal is an international law therefore legally binding (all the 28 members states agreed with it). We also know that the UK might vote to leave the EU in the upcoming referendum in wh...

Re: New EU deal: Free-movement rights gone?

Forgive my ignorance. Does the new laws change the nature EU nationals practice their EU rights in the UK? For instance if the new laws come to efect, EU nationals will still be considered practicing their treaty rights by being self sufficient with CSI right?

Re: New EU deal: Free-movement rights gone?

Just make sure your wife remains a worker until you get your permanent residence. However, there remains the issue of what rules apply to the 2nd EU state a couple reside in. You, Nemerkh, should be OK because you are already in your 2nd EU state. (What happens if England leaves the EU is another q...

Re: New EU deal: Free-movement rights gone?

RichardW, Just out of curiosity, what did you mean with your statement: 'While this will make the EEA route more difficult for those using real jobs, it will preserve free movement within the EEA.' Who are 'those using real jobs?' Also, what are your thoughts about how this new proposal, should it ...

and to those who still think free movement rights are gone: In the Brussels agreement last week (18 february) there is no amendment of the Lisbon treaty, and no amendment of directive 2004/38. There are very different signals flying around. In the Conclusions of the European Council meeting (18 and...

Re: New EU deal: Free-movement rights gone?

Funny Petaltop I know one or two noneu/eu family who got their PR and subsequently citizenship here by providing false docs (fictual work) and having criminal records; we genuinely couldnt make it due to child care and were punished by reapplying for eea2. Now this shit is happening. C'est la vie i ...

Re: New EU deal: Free-movement rights gone?

After doing a bit of reading, the emergency brake is applied only to newcomers with David Cameron emphasysing that. Also the child benefit payments will start getting indexed in 2020. There is no mention about the no eu thingy but am assuming in this case it should be applied to new comers
