the honest answer is the divorce looks scary and additionally i have just managed to get a job and losing my passport for 6 odd months to UKVI wont look good to my new boss. My current residence permit is valid for another year

If you have not been divorced and its your fifth wedding anniversary you should have acquired PR at that point without having to live together. that will only work if you have enough evidence to prove your spouse has been qualified for 5 years

I read the link in your comment and noted the same applies to the non eea person when they have retained residence rights. Have i understood it right? i mean non eea could travel purely due to work reasons when his or her ROR application (residence card) is under review.

according to my research you do not require his passport
as long as your husband is employed you don't need extensive evidence of that as the home office can find out as long as you tell them where he is what he is doing and which company.
