But what if your business didn't need the entire 50,000, and a small amount is left in the business account. Do you have to spend it for the sake of extension?! @ whiteroses, the rule of the visa is that the whole £50,000 should be spent in your business, no excuse at all if you cant spend it all.

@ hammad ahmad, your case should also be a straightforward win at the Upper Tribunal if Home Office doesn't come up with other points during the course of the appeal. Just make sure you are following the rules of active trading to show that you are indeed a genuine entrepreneur.

@ naveencandy8, you need to VARY your existing second Tier1 application to Tier2 application. It doesn't matter waiting for the decision if you have already decide to switch to Tier2.

@ Lab, you will need to make sure that you have your own 50k funding if your team member have decided to pull out of the business.

@ naveencandy8, if you have decided to apply for Tier2 visa, then simply fill the Tier2 application form and send it to HO with a covering letter asking that you want to VARY your existing Tier1 application to Tier2 application.
