@ bizz123, if you can defend all the refusal point, then go for JR and get an experienced barrister to represent you.

In regard to submitting a 3rd application, it will be an automatic refusal as you would have over-stayed for more than 28 days since your last appeal was dismissed.

@ BharathRao, if your Tier 1 enter application get refused, your application fees won't be refunded, but your NHS surcharge fees might be refunded.

Your previous Tier 2 ICT visa will still be valid.

I think the only option you have is to go for JR if your refusal reasons in the second application can be defended in front of a judge.

@ YouKTier, you should be fine as you have employed 2 full-time worker for 1year each as stated in your post regardless of the fact that the second job was a combination of 2 other full-time workers who both work for combined 12months .

@ malik10, obviously yes. This is part of the condition for Tier 1 entrepreneur visa and it applies to everyone on the visa who want to either apply for extension or are applying for settlement.

So you have to be in UK for at least 6months and 5days every year before you can qualify for ILR.
