@ danish7866, usually Home office representative always stick with refusal points during hearing, but it doesn't mean that they aren't allow to point out any unusual documents in your application. They are even allow to cross examine you again during appeal hearing which sometimes is real interview....

@ goldenpig17, if your UNI refuse to issue another CAS letter, the implication is that they don't want to refund any money as the refusal is solely your fault. But if you are ready to pay another money then am sure your UNI will definitely issue you a new CAS for you to apply from your home country....

@ danish7866, you can pursue an appeal if your business is actively trading as the chances of winning is high.

Are u on 50k or 200k route? I ask this as your service seem to be selling of particular products according to what you have stated in your market research.

@ saif009, from what you have stated earlier, you might need time to get your dependant application ready, so submitting your permission request first to FTT and then UT will give you enough time to be prepared and also to avoid making any mistake if you rush your application. Best option is to wait...

@ saif009, send in your appeal permission request to Upper tribunal first to keep your legal status continuous and then you can then plan your dependant visa. The dependant visa is your best and easiest option as you have been married and living together with your wife for 4years.

The argument is not solely about section 3C but about legal right of continuous stay in UK during JR.

Regardless of my view, few applicants have successfully got ILR while awaiting JR outcome.

@ davvo, you should ask your solicitor to send your PAP letter for JR while awaiting docs from HO so that you can continue to have legal basis of stay in UK just in case you get stopped at any time.

SAS request do take couple of weeks so its better to put everything in place before it arrive.

Time spent while waiting for JR do count towards 10years long residency, the only issue is that Section 3C does not apply while waiting for JR, but if an employer does not stop an applicant from working, then there shouldn't be any problem. @ andee_nab, yes you can decide to submit fresh application for Tier 4 visa, but you should get a CAS letter from a school first before withdrawing your appeal. Getting a CAS letter will be very tough but not impossible.
