AIUI, dual UK/Irish citizens cannot avail themselves of EEA rules in UK and so in these cases are considered British only.

In any case as you have ILR you are firmly under UK rules for immigration anyway.

Have you contacted anyone at the Department of Foreign Affairs about this? I was curious and read through the Act and it seems what you're saying is true, but realistically I can't imagine it would work out. In theory wouldn't that mean that basically everyone born prior to 1956 with any Irish ance...

Chances are being caught are very low, I cross the border a lot (M1) and I've seen nothing, though I think there is a pull-in area on the motorway that they must use for border checks if they ever bother. More risky if you stopped in the North by PSNI officer etc or have an accident etc, can happen ...

I think if you separate and move back to France with your daughter he will have no valid leave to remain in EU.
