Out of country applications cannot be appealed, they can only request for administrative review of the documents and form provided. He will need to make a application again, state in that his previous rejection was provided and that he willingly withheld the details on the advise of the employer!!! ...

I would be one of those coming back to UK under the new rules (post 6 Apr 2012) so I guess I am permitted a maximum of 6 years only (1 renewal).

So ultimately I will need to make sure I meet the criteria for ILR during the time here or look for other prospects outside UK after that duration.

You should have filled the form before you signed it to know what you signed up for. They would most likely fill in that you applied for unpaid leave till the date they claim. Technically if you can prove that you were working (after you were granted leave to remain) then by law they have to pay you...

Considering you filled a application for unpaid leave you technically waived them of any wrongdoings.

I would recommend you drop this and accept it or risk burning bridges with your employer.
What is more important you can choose.

Applying for settlement applications from india will take a LONG TIME! You are better off forking some extra money and getting a In Person application for ILR for baby from UK. If she has a degree taught in English and not in an english major speaking country (see UKBA definition) then get it endorsed by UK NAIRC as a UK equivalent Bachelors or Masters degree.
That will help meet the requirement along with KOLL.

What happened is most probably in Appendix 5 they claimed points for RMLT instead of the shortage occupation category which confused the ECO.

You cannot mate, see the ILR rule changes for Tier 2 ICT after Apr 2010.

My CoS application was made on 05 Jan 2014 and it was approved.
The UKBA website even published the statistics for Restricted CoS Allocation so your employer should be able to see on SMS if it has been approved.

Waiting for my Tier 2 General Priority application to come through now :)

Quite an interesting post... so annual increments do not need to be reported but if core duties change then Change of Cirucmstances form needs to be completed. What happens if a change of circumstance form is completed? Will the employer need to do a RLMT to see if they can use a resident worker and...

Would there be any implications of a Tier 2 General visa holder receiving foreign income from renting out his properties?
Can UKBA or HO consider this as being self employed and cause issues?
