Re: Length of time between employers?

The timeline will also depend almost entirely on the new sponsor - are they already licenced, have they done a RLMT for the position, do they have Unrestricted CoS ready to be assigned etc. I recently went through this and it took around 3 months from last interview to getting the new visa approved ...

If the new application is rejected, she can even continue working with the current employer as long as her current visa is valid. Brave move to let the old employer know be...

Re: Tier 2 general visa actual status

The advice is to always tell the truth. Was this medical leave? You could have issues if you have stopped working for your employer for those months (or even for one month) without a maternity, paternity or sick leave justification. Were you still getting paid? Was the arrangement that this was temp...

Re: Tier 2 General (Changes of employment)

Your sponsor might have written your job title like that on the COS - might be worth checking with them.
Otherwise, I don't see major issues... but always worth notifying if there is a discrepancy.

Re: 5 year cos vs 3 year application

There is a chance they will reject it if you apply for 3 - or simply offer you to pay for the difference.
But you cannot use the 5 year COS for a 3 year visa.
I would not risk it.

They cannot change the type of COS, I'm afraid. Either assign a new one or you apply for 5.

Re: Tier2 to ILR absences

This should be fine, provided that:

- You didn't spend more than 180 days in any given year outside the country

- Your employer writes a letter confirming you were working during those dates.

Re: Tier 2 to ILR 35000 salary

See below for answers: 1: Question is all level 4 experience salaries range 19000 to 25000 normally. How UKVI demand 35000 on level 4 job. They can demand whatever they want. Remember, this is no longer a work permit, this is a settlement visa, so they're allowed to define the threshold earnings for...

Re: Role change in Tier 2 General

Hi, I came here 3 years ago on tier 2 general visa. Now my employer is going to change my role. Although my new role will still be in the same SOC code but It's making me a bit worried. 1. Does it still require RLMT? 2. Would it require a new CoS as well? 3. Should I or my employer notify this to U...

All you can do is apply again with a fresh COS, as the mistake was on your side.
Admin review would only apply if the HO had made a mistake.

Hi there, Both requests seem very specific to your position - therefore, I don't think anyone here would be able to advise exactly on what to show them without knowing more about the job/context etc. If there is a request for a business plan, it seems this is a brand new role, department or company?...

Don't risk it by counting the beans to qualify for the minimum.
Use this to your advantage, go to your employer and say they have to pay you more.

Re: ILR on Tier 2 - £35K

To get ILR, you need to earn a minimum of 35k a year, irrespective of working hours. It's a good opportunity to discuss a salary raise, you've been there for 5 years and they really shouldn't treat you as cheap labour to save a couple of hundred pounds a month. Stop calculating and hoping you'd qual...

Re: UKVI asked for further payment

It's nice of them to offer you to pay the difference. Once that's done, it should then be considered on its own merits, if that's resolved they wouldn't punish you for that - but everything else needs to be in place for it to be approved/granted.

Re: UKVI asked for further payment

Once a COS is assigned for over 3 years, that's pretty much done - I don't think the sponsor note is enough to amend it to less than 3 years, as it's a different kind of application. If your first visa was 2 years, you could potentially stay for further 4 - a total of 6 years under Tier 2 - so this ...

If you haven't given notice to your current employer, the unsuccessful application will NOT affect your current visa. You can still work for your current employer as long as your current visa is valid and even extend it before it expires should you wish to do so. Not doing a RLMT for a change of emp...

There's a new priority service in which the company can pay a fee to have any decision on allocation or sponsorship licence changes processed in 5 working days. Might be worth checking.

You can use the SMS to issue a new one, send messages etc - but it wouldn't officially change a COS that's been used and applied with.
