It's not that much of a mess Lucapooka (probably was a bit over worried with my first post maybe) As long as we can stay and continue to build our life here we will be more than happy, not bothered how long it would take for her to get ILR. As long as we are doing the right thing and abiding by the ...

Thanks Greenie. She was close to passing the KOL every time just 1 or 2 questions out so it does seem crazy. So even with this application pending she could do another KOL test and apply for ILR or an English test and apply for FLR? Would these be brand new applications or just send the certificates...

Help with wife's DLR application please

Hi My wife made an application for DLR in December 2011. The reason for this was her spouse visa expired January 2012 and her intent was to apply for ILR but she failed her KOL test (3 times) so couldn't make the application. She was then going to apply for FLR but we did not know about the rule tha...

Next week will be 11 months since my wife's DLR application. I know a lot of cases can be complicated (my wife's isn't) but it's going to be coming up to a whole year soon since her application. I can't think of any other situation where you pay so much money yet have to wait so long for something. ...

As the Isle Of Man isn't part of the UK, I guess she will have to stay at home then. Disgraceful that is, I thought there would be a separate rule for matters like this.

Thanks anyway.

travelling abroad for a funeral

Hi My wife is currently going through her DLR application so the UKBA have her passport. The problem is my Mum passed away this week in the Isle Of Man while on holiday and because she was born there the funeral may be held there. Is there some kind of temporary travel document my wife could get to ...

I think biometrics for DLR applications only came into force late Jan/early Feb 2012, so if application was before then, they won't be needed.

The easiest way way to contact your MP. Go to www.writetothem.com and type in your postcode then you will be directed to your local MP where you can then write out an email for them. Just explain your situation and ask if they could look into the matter for you. I got a reply the same day asking for...

@Elisha47. It might be worth you contacting your local MP too. I'ts straightforward enough and mine got back to me with an answer within a day. Although it wasn't the answer I was hoping for.. RE the changes for DLR. I'm pretty sure anyone who applied before the changes came into place won't be affe...

My MP's office actually got back to me today with the response from the UKBA being that my wife's visa has still not been processed and when asked how soon it would be dealt with they wouldn't give an exact answer, just saying as soon as possible. It was the reply I was expecting really, and I think...

@Elisha47 The grounds were. My wife didn't pass her KOL so she couldn't apply for ILR and we left it too late for her to take the English test she required to apply for FLR. She had been on a normal spouse visa before and with us having a British born child we applied for DLR. What were your grounds...

Discretionary Leave To Remain

Hi My wife applied for DLR using form FLR(O), at the end of December 2011 and got her acknowledgement letter 3 Jan 2012. We still havn't heard anything yet so I was wondering if anyone knew the timeline for DLR applications? And is it worth contacting my local MP regarding this yet. Also she never r...

What would happen if they didn't issue Discretionary Leave then? Surely they wouldn't ask her to leave the country especially with a baby daughter, I wouldn't think they could separate Mother and child... Yes we are using the FLR (O) form and asking for Discretionary leave, we think this is the safest option for now.

Thanks for the reply Obie. So the downside to applying late for ILR would be she would have to quit her job. Can she take the English language test for ILR instead of the KOL or is the the English Language test just for FLR? If she fails her KOL again and we go for FLR is it also ok to go for FLR la...

I had no idea she could apply for ILR after her spouse visa has expired, I thought she would get in all kinds of trouble for that. Hi My wife's spouse visa finishes on 30/12/11 She has failed her KOL test 3 times, the 3rd one today.
