It will go against the treaty rules for an EU state to stamp the passport of memberstates citizen. This is prohibited.

Re: Loss British citizenship

You advise on this thread seems unimpeachable. I cannot add anything substantive to it.

The child appears to have acquired nationality lawfully, and the OP need not worry herself about paternity issues.

Re: Loss British citizenship

Mother wasn’t married yet to husband. That considerably complicates matters. If the parents were not married at the time of the birth of the child , the child may very well not be a British citizen. @vinny @Obie , any thoughts on this niche issue? It may help to know when the child was born. As a c...

Re: Long Term Irish Visa for Naturalised Citizens who don't have Irish Passport

It is absurd, to require a citizen to apply for reentry visa. It makes a mockery of stamp 6 and put stamp 6 beneficiaries in a disadvantageous position to other stamp holders who do not require a reentry visa. I think the main issue is airlines and foreign countries’ exit controls do not recognise ...

Re: Long Term Irish Visa for Naturalised Citizens who don't have Irish Passport

It undermines the entire point of stamp 6, if airlines dont accept it. The Irish government has a duty to explain it to airlines.

The equivalent of a right of Abode, that is issued to British citizen on their foreign passport is accepted by airlines.

Re: Non-EU partner joining EU/UK dual national; a particular case (treaty rights exercised?)

You do not qualify under the EU settlement scheme. Your case is a Surinder Singh case, and your partner ought to have resided with you in another EEA state, for you to qualify.

Lounes does not apply, as you have always been a British citizen since birth.

Re: Zambrano Route or EUSS ?

Hello, Mods and Expert any advice will be highly appreciated. I work for a very reputable investment bank and have been offered a role in Qatar, so I called my solicitor to see if in any way I can take that role due to the fact on FLR FP there are conditions which doesn’t allow us to work abroad or...

Re: Non-EU Family Member - how to get a 2 entry tourist visa for Ireland?

Either you applied for the wrong visa, or your wife was issued the wrong visa. EUTR is mostly for those who intends to live in Ireland. The visa allows the applicant to come to Ireland and apply for a residence permit. It is not intended for tourism. In the Avats website, which visa type and reason...

Re: Undocumented Regularisation Scheme 2022 Timelines

Usually to register, the officer will ask you to provide proof of where you live, the letter from the minister and your passport..

They are not assessing your claim, they just want to know you live in the area you claim to be residing at..

The letter should have advised you on what to take along. You already have the permission, what you are going for is registeration of it.

Re: Zambrano Settled Status EU settlement scheme Paper Application Form - NEW

Things are not going too bad, Home Office appears to be relenting in their pursuit of mandatory appeal against allowed Zambrano appeals.

The last 3 appeal decisions I have had was not challenged. Maybe they have decided to ignore the appeal determination, which will be another matter.

Re: EUSS Refused going for Appeal Process (ADVICE)

Well she may be wrong on that, as there is a duty to facilitate in circumstances where a durable relationship exists before the 31-12-2020.

That duty does not extend to other Extended family members, but it certainly applies to durable partner.

Re: EUSS Refused going for Appeal Process (ADVICE)

Any Marriage that takes place after 31-12-2020,will not qualify under the withdrawal agreement.

If you can show your relationship was durable before the 31-12-2020, you may succeed.

The problem is, your application appears later, as it ought to have been submitted before 30-06-2021.

Usually when the Immigration rules define people with presettled status, it does not usually includes non-EEA national, it is actually referring to EEA national.

Non EEA national with PSS can actually sponsor no one.

Re: Inform GNIB if moving to Belfast?

I'm suggesting that the ceasing of being a resident of the state, the misuse of IRP cards whilst not being a resident, and failure to declare the change of address may affect that. I think misuse is a big word, i will not use it lightly. What this OP did, does not appear to be abuse or misuse. He w...
