It’s not cancelled, it’s just not added to your credit report if paid within one month. Yes you need to declare it and submit evidence of it being settled and you should be ok.

I think you were lucky not to be prosecuted for money laundering. I assume you were not arrested or charged for an offence. Have you a copy of the marker, what does it say? The Home Office can view credit reports so it may be important what it says.

The relevant law which states who can, rather than who can not receive such credits, can be found in Regulations 2 and 5 of the Social Security (Contributions Credits for Parents and Carers) Regulation 2010 (SI 2010 No. 19) and Section 23A of the Social Security Contributions and Benefits Act 1992.

JB007, that advice is not correct. It is possible for a person to transfer their NI credits (class 3 which count for state pension) from child benefit to their spouse/partner. When making your application for further leave then you should clearly state you require access to public funds due to risk of hardship/destitution and state the exceptional circumstances eg children, health issues etc….
