Re: ILR refused for T1E

Oops! Got your point now (having read the current Tier 1 E guidance "carefully" - which I had not when I had posted earlier). Apologies!! Then one needs to ascertain when this clarification (accelerated route to settlement cannot use transitional arrangement) was announced in statement of changes t...

Re: ILR refused for T1E

156 applies to both pre and post 06-Apr-14 applicants. For pre 06-Apr-14 applicants, 156 can be fulfilled either in the manner explained in 165 or as explained in 156. For post 06-Apr-14 applicants, 165 doesn't apply. So, where is the contradiction? Or am I missing something? That is precisely the ...

Re: ILR refused for T1E

Tier 1 (Entrepreneur) policy guidance version 11/2015 Read 167 first. Then read 156 - 166, and 205. Though not stated so explicitly (as in the current guidance) but the jist is the same, IMHO .. Thank you, Geriatrix. As per 167. If you are applying under accelerated ILR you must demonstrate that yo...

I completely concur with helpingperson, Momi and deepakjr123.

Coming back to the main point, does anyone know of any solicitor/barrister experienced with such cases?

Re: Entrepreneur-New Guidance-HO-Challenge-ILR-Accelerate Ro

I completely agree I for one have invested over 400000 Employees were given Prefrence on who complied to the HO regulations rather than their capability. Had some amazing applications where they were allowed to work as dependants etc but did not hire them and gave Prefrence to those who had a Europ...

Re: Entrepreneur-New Guidance-HO-Challenge-ILR-Accelerate Ro

Hello all, I have submitted my accelerated ILR application on the 17th of March, before the new guidance was issued and things about the transitional employment 'clarified'. I have recently read about the applicants who applied using the same route in December, and got refusal on the basis that tran...

Re: New Tier 1 Entrepreneur Guidance

To be honest I am starting to repeat myself here :? Where it says jobs lasted full time for 24 months won't be counted as 2 jobs? The guide is clear that transitional arrangement does NOT apply for accelerated ILR. An employee working for 24 months means you created ONE single JOB/POSITION not two....

Entrepreneur ILR - English test not needed

Hello everyone, I've just stumbled upon this while reading the policy guidance. Article 223; You can also meet the English language requirement, without the need to provide evidence, if you were last given permission to stay in the UK:  under Tier 1 (General), Tier 1 (Graduate Entrepreneur), Tier 1...

Re: Earliest date for ILR + English test

To apply for entry clearance and/or extension in the past, did you have to submit your degree certificate to fulfill some requirement? No, I believe there's a risk then, because the caseworker may ask for evidence to prove that the degree is yours (e.g. - letter from University confirming that the ...

Earliest date to apply

Hello all, I got my Tier-1 Entrepreneur visa on 19 February 2013, and entered UK on 03 March 2013. The visa has an expiry date of 19 June 2016. All the criteria have been met, including 10 full-time jobs. As per my understanding, the criteria has to be met within 3 years of visa approval and ILR can...

Do I need to declare this?

ILR . Click on the given link for more information. Thank you Vinny. So assuming all the other conditions are met, I can apply right after I complete 3 years. I got my visa on 19/02/2013, and entered UK on 03/03/2013 hence I can apply from the 20/02/2016 onwards. Does the 28 day rule not apply here...

Re: WHEN CAN I APPLY FOR EXTENTION AFTER THE END OF MY INITI

Apply shortly (no sooner than 28 days) before your leave expires. It's okay to apply for an extension between Tuesday, 26 December 2017 and before your leave expires. You may also apply earlier, if you wish. All you need is an enough extension to complete your relevant residence period in the UK, b...

Thanks for reposting the previous reply. I did read that. Even though it is helpful it does not answer my questions. I don't have time to ask for data from SAR. Therefore I ask: - How are the actual travel dates checked by the Home Office? - What are the consequences from missing some travel dates ...
