since the date your application deemed invalid.
If your out-of-time application is accepted and eventually successful, then the period of over staying will be less than 14 days which will not affect your ILR.

If your application was returned as invalid and your leave has expired, you become an overstayer. You get the same 14 days to apply and your new application will be out-of-time

Did you apply for extension before your leave expired ? Then you are protected under section 3C and the letter probably is issued by mistake. Please contact the number I posted as I have no more information on this.
Based on the case worker guide procedures for variation of leave, you just need to pay the difference. The question is how to do this and I am not knowledgeable on this.

My question is if I apply with my wife in march 2018 and don't send my son application( as he will have 9 months on his visa and I can apply for his British application when I get ILR) to save money .will it be fine ? Yes, there is no need to include the child born in the UK in your ILR application...

Technically your application is SEPARATE and it is NOT linked to your partner. However you must show you invested total of 50K in your business personally or with your partner. You better keep him as a director until your extension is approved
