Re: Help with Covering Letter Pls?

What wording do you require help with? You will need to apply for an EEA family permit for the children. Children under 21 of the EU national or their spouse are covered automatically by the directive 2004/38/ec.

Re: WRS registration

Generally, absences of up to six months per twelve do not interrupt residence, except for one period of up to twelve months for important specified reasons. See directive 2004/38/ec for details.

Re: EEA4 and time before marriage

Generally, you need to have been living in the UK as the family member of an EU national for five years. For those who are not automatically family members - e.g. durable partners, they require to have their status confirmed first. You don't appear to have done this. In short, you need to wait for f...

Re: RC EEA2 refused... need advice....

I just noticed that the OP is working for a temporary work agency - would this have been an issue? I.e. she is probably working as a temp and not a 'permanent' staff member. Would such an issue exist? I can't see why this would be a problem. Perhaps, it might be less convenient than "conventional" ...

Re: Improvements for the new forum

There is an option to mark posts as read in individual forums. I don't see there being an option to mark the whole board as read.

Re: Improvements for the new forum

It used to be the case that once logged on, and then, after logging off, all posts were marked as read. Therefore, once one logged on latter on, only the posts made since last logged on were highlighted. That said, I'm guessing as to what the poster itk means by "it was better before, please change ...

Re: New online visa app for EEA family permit

If the form is not clear, you should inform UKBA. I suspect they believe the form to be crystal clear. An application ought to be very simple indeed. Show that you are the family member of an EU national who intents to exercise treaty rights in the UK, bearing in mind that for the first three months...

Re: Does the Directive 2004/38/EC apply to C-type visa?

In order to demonstrate that a parent is dependent on their child, they would need to provide evidence of this. If your mother can travel to the UK independently of you and doesn't normally live with you, she may not be dependent on you. There is guidance on constitutes dependency, but you will need...

Re: New service standards for applications made in UK

I saw the link. The UK can and does restrict access to the job market for the new member state, Croatia. The UK is meant to provide Croatian nationals with at least the same access to the job-market as non-EU nationals. For students and self-sufficient persons, the UK must issue a residence certific...

Re: EEA Family Permit Appeal

Hello, my husband is an Australian with a Greek passport and I am Australian. We applied for an EEA Family Permit in Athens in September 2013. Our application was then sent to Serbia for processing. Two weeks later it was refused on the grounds that we did not prove that our marriage was not one of...

Re: Does the Directive 2004/38/EC apply to C-type visa?

Firstly, in order to benefit from directive 2004/38/ec, your mother would require to be dependent on you. If this were the case, you could argue that the directive mandates that member states provide every facility for the visa to be issued. They generally expect applications to apply in the country...

Re: URGENT: Refused 1A stamp & denied entry as visitor

I understand you entered under the immigration rules (you've confirmed this). You may well find that a gap between living in an EU country and returning to the UK cannot be used as a reason for refusal. However, this was the argument used by the IO on your first attempt. If you were to successfully ...

Re: URGENT: Refused 1A stamp & denied entry as visitor

Can anyone advise on implications of applying for RC with EEA2 while on limited leave to remain? What if the leave expires while waiting for the RC, or while waiting for the CoA? Could she end up overstaying? For a non contentious case (let's say French citizen living in the UK legally with non-EU ...

There will not be a problem at a UK border. What might happen abroad is a different matter. The airline should be straight-forward enough. If there are any problems, remain patient, but don't be fobbed off.

An application for a residence card ought to be really simple. Generally, the important items are passport, proof of relationship to EU national, proof that the EU national is entitled to a residence certificate (is a worker, self-sufficient person or student).
